Can Landlords Require Renters Insurance In Nyc

How to get good New York Landlord insurance policy.

Yes, landlords can require renters insurance in New York City. However, that doesnt mean that they always do. What Does Renters Insurance Not Cover In New York

Renters Insurance usually will not cover anything outside your dwelling and might not cover property damage for all perils. Below is a list of a few things usually not covered on your renters’ policy:

  • Bed bugs and pests – The majority of renter’s insurance policies will not cover damages associated with bed bugs, with limited exceptions. Along with other pests, such as rodents, they are considered a maintenance issue and are therefore ineligible for coverage under your typical renter’s policy.
  • Earthquake and flood damage – Renters coverage does not usually include earthquake or flood damage. Still, if you live in a high-risk area and can’t get earthquake or flood coverage through your renters policy, you’ll need to purchase an additional policy for those perils. But, again, speak with your renters insurance company about these options, as they’re often available to add-on.
  • Car theft or damage – If you own a car, the renters policy will not cover damage or theft. Your best option is to purchase a comprehensive insurance package that also protects your vehicle from collisions and weather-related damage. This way, your auto and renters insurance can work in tandem.

How Should I Tell Tenants Renters Insurance Is Required

Cuomo signs bill extending eviction protections for New York renters

The best way to tell tenants renters insurance is required is with a letter. Whether its a new tenant or a renewal lease, its always helpful to point out changes to the lease and specific policies and rules that apply to the housing youre renting to them.

Not sure what to say? Heres a sample letter to advise them:

Dear Tenant,

One of the requirements of your new lease is that you must maintain at least $100,000 of personal liability insurance. The most common way to do this is with a renters insurance policy. The landlord disclaims any and all responsibility for damages to your personal property arising from fires and other events. However, a renters insurance policy generally will include personal property coverage to protect your belongings, as well.

All adult residents living in the unit must be named on the policy.

You must name the landlord as additional interest on this policy. This means the insurance company would notify the landlord in the event of a lapse or cancellation. Additional interest and Interested Party are the only acceptable designations. The additional interest should read as follows:

Landlord Name, Mailing Address, City, State, Zip

Please provide a copy of the declarations page of your policy meeting the requirements listed above prior to moving in

This is an important component of your lease. Failure to keep the required coverage in force will be considered a breach of the lease and is subject to any and all of the same remedies.

Q: Im a renter living in a Midtown co-op, subletting my apartment from a shareholder. The co-op board recently changed its rules, and now requires all shareholders and subletters to purchase renters insurance. But my landlord is the shareholder, not the co-op, so am I really required to follow the co-ops policy? Since my sublease does not include any requirement about renters insurance, how could my landlord enforce such a rule?

A: Your sublease may not explicitly require you to get renters insurance, but you will probably have to get it anyway. Your rental agreement most likely includes a provision requiring you to comply with whatever obligations the shareholder has to his or her proprietary lease, the co-op bylaws and the house rules, even if they change after you move in.

Its not uncommon for a subtenant to find out that the house rules have changed you cant have potted plants on the windowsills anymore, or something more substantive, said Eric D. Sherman, a real estate lawyer and a partner in the Manhattan office of the law firm Pryor Cashman.

What Is A Renters Insurance Lease Clause

Your landlords insurance policy only covers their property and does not, in any way, include anything which belongs to the tenant.

This is where a renters Insurance policy comes in.

A renters insurance is a policy that covers the tenant, their belongings and potential liabilities that may occur on the property while they are living within the premises.

In the case of an unexpected loss, a tenant may experience damages or want to recover them. For instance, a fire destroys an apartment, leaving thousands or millions of dollars in costs.

The tenant is quite unlikely to have the ability to make good on those damages. To guarantee the tenants performance under the lease agreement to take responsibility for those damages, the tenant will require a renters insurance policy.

The tenant cannot just say, Yes, Ill pay for those accidental damages if they happen, without a way to fulfill the obligation.

A renters insurance lease clause ensures that the tenant can and will fulfill that obligation, should it come to be necessary. The renters insurance also simplifies the process of getting the money, which will now come from the insurance company and not the tenant.

2) Hot Water

Every bath, shower, washbasin, and sink in a single- or multi-family property must be supplied with hot water between the hours of 6 AM and midnight. Individual dwelling units must have at least one window per room that opens to a street, courtyard, balcony, fire escape, or suitable setback within the property. Each window must also provide adequate lighting for the room and should be easy to open for ventilation.

4) Smoke & Carbon Monoxide Detectors

How Long Does A Landlord Have To Fix Something In New York

Tenant Insurance Vs Landlord Insurance | Who’s Covered? | Square One

In New York, there is not an explicit number of days in the law that says how long a landlord has to make repairs. Its considered the standard for landlords to fix something with a reasonable amount of time. If landlords fail to make repairs within a reasonable amount of time, renters can do a few things such as withholding rent, or eventually go to court and sue them. However, landlords have to follow the warranty of habitability which means the rental has to be safe and livable for example, if the heat was broken or the water turned off the landlord needs to fix these issues so the unit remains habitable.

Liability Coverage And Defense

Ultimately, the difference isnt very extreme. Landlord insurance policies provide liability and defense coverage to landlords while renters insurance does the same for tenants.

There are situations where you or your tenant may find that they or their insurance company needs to file a claim against the opposite party. In these cases, the claim would be filed against the individual if there is no liability policy there for protection. That is why it is always advisable for both parties to have this type of protection in place.

There are even cases where both the tenant and landlord will need to defend themselves. If a third-party gets injured on an unshoveled sidewalk, for example, both parties are likely to have some type of liability, and their insurance policies would help cover that.

Will Tenants Push Back On The Requirement

If you tell tenants renters insurance is required, you will almost never receive pushback from them. Renters insurance is a few dollars a month, and almost all landlords now require it. People are getting used to the requirement, and its not a significant strain on their budget.

However, if a tenant is adamant that they dont want to buy Idaho Renters Insurance, that may be a signal of a problem tenant. Do they go off on an ill-informed rant about their rights as a tenant? Do they become confrontational over it? Those may be red flags of other negative tenant behavior.

Its easy to tell tenants renters insurance is required when you make it part of the process of showing and taking applications for the apartment. Mention it, put it in writing with the additional interest requirement, and its easy. For convenience, make sure you provide tenants with an email address to send a copy of their coverage to.

One more thing to be aware of. If you require renters insurance and you receive a cancellation notice from the insurance company, do not just accept the original declarations page from the tenant. What you need to see is a reinstatement notice. The declarations page they received six months ago does nothing to prove they have coverage today!

Oh, and if youre curious, heres why you as a landlord want to be additional interest and not additional insured on your tenants policies
