Dear Tenant,

One of the requirements of your new lease is that you must maintain at least $100,000 of personal liability insurance. The most common way to do this is with a renters insurance policy. The landlord disclaims any and all responsibility for damages to your personal property arising from fires and other events. However, a renters insurance policy generally will include personal property coverage to protect your belongings, as well.

All adult residents living in the unit must be named on the policy.

A: Your sublease may not explicitly require you to get renters insurance, but you will probably have to get it anyway. Your rental agreement most likely includes a provision requiring you to comply with whatever obligations the shareholder has to his or her proprietary lease, the co-op bylaws and the house rules, even if they change after you move in.

Its not uncommon for a subtenant to find out that the house rules have changed you cant have potted plants on the windowsills anymore, or something more substantive, said Eric D. Sherman, a real estate lawyer and a partner in the Manhattan office of the law firm Pryor Cashman.

There are situations where you or your tenant may find that they or their insurance company needs to file a claim against the opposite party. In these cases, the claim would be filed against the individual if there is no liability policy there for protection.
