This raises the larger question whether the legislature should, when delegating authority to conduct a civil act to religious officials, have standards at all. Is it the governments place to decide who or what qualifies as a religion, a church, or a minister?

While the New York Court of Appeals might weigh in this issue, he real remedy, if one is to be had, should come from the legislature. The state treads on dangerous ground when it tries to pick and choose among religions or religious officials on the basis of their religiosity.

    Monell And Qualified Immunity

Putnam County Clerk Nabors asserts that Plaintiffs claims are barred by Monell v. Department of Social Services of New York, 436 U.S. 658, 98 S.Ct. 2018, 56 L.Ed.2d 611 , while Hamilton County Clerk Knowles argues that he is entitled to qualified immunity. Both arguments are inapplicable to the allegation in this case and fail for that reason alone.

In Monell, the Supreme Court held that “a municipality cannot be held liable solely because it employs a tortfeasor” Id. at 691, 98 S.Ct. 2018. In other words, “under § 1983, local governments are responsible only for their own illegal acts. … They are not vicariously liable under § 1983 for their employees actions.” Connick v. Thompson, 563 U.S. 51, 131 S.Ct. 1350, 1359, 179 L.Ed.2d 417 ). Therefore, “a municipality is liable under § 1983 only if the challenged conduct occurs pursuant to a municipality’s official policy, such that the municipality’s promulgation or adoption of the policy can be said to have cause one of its employees to violate the plaintiff’s constitutional rights.” D’Ambrosio v. Marino, 747 F.3d 378, 386 .

This case has noting to do with a municipality, a municipal policy, or allegedly rogue municipal employees. Rather, it is a case challenging a state law implemented by state official. Monell is simply inapposite. See Barachkov v. 41B Dist. Court, 311 F. App’x 863, 872 Estate of Young v. Martin, 70 F. App’x 256, 260 .

Both sides on this issue have responded heatedly to the decision to pass the bill. Legislators have commented that the measure is critical to improving the public health at a time of a serious and ongoing measles epidemic.

The legislators who sponsored the bill stated that it would still allow for medical exemptions from vaccines. Another legislator who co-sponsored the bill commented that the measure has received increased support as people begin to realize how important vaccines are to public health and safety.

Despite efforts to educate citizens on the public health benefits of vaccinations, protests over the measure erupted as religious rights advocates crowded New Yorks Capitol building to urge legislature to stop the bill. Ultimately, the vote to pass the bill was close. The Assembly had one vote more than the minimum needed to pass the bill. Polls reveal that despite this narrow vote, the legislation is supported by 84% of voters.

    Foundation And Early Growth

The Universal Life Church was founded by Kirby J. Hensley, “a self-educated Baptist minister who was deeply influenced by his reading in world religion”. Religious scholar James R. Lewis wrote that Hensley “began to conceive of a church that would, on the one hand, offer complete freedom of religion, and could, on the other hand, bring all people of all religions together, instead of separating them”. With this aim, he sought to establish “a new religion that would emphasize what all religions have in common”, establishing this entity in 1959 under the name “Life Church” in Modesto, California. He first held services in his garage, and incorporated the organization in 1962.
