Violation For Sales To Individuals Under 21 Years Of Age
Whenever a violation is sustained against you for a sale of tobacco or other age-restricted product to an individual under 21 years of age, besides imposing the payments of a fine and a surcharge, you will be assigned two points, unless you demonstrate that at the time of the sale, the seller possessed a valid certificate from a State certified tobacco sales training program2. In that case, only one point will be assigned.
Points will remain on your record for 36 months, unless your registration is suspended.
If you are assigned three or more points, your registration to sell tobacco products and herbal cigarettes and/or vapor products and, if you are a lottery agent, your lottery license, will be suspended for one year. When the suspension ends, three points will be removed from your record. Any remaining points will count as the basis toward another suspension.
Whenever any points are assigned to a retail tobacco dealer and/or vapor products dealer, at least two re-inspections will be conducted each year, until the points are removed.
If you have been found guilty of ANY four violations of this law within a three-year period, the enforcement officer will direct the one-year revocation of your registration to sell tobacco products and herbal cigarettes and/or vapor products, and of your lottery license, if you have one. This will occur in addition to imposing a fine and a surcharge, and even if points were assigned for any sale to an individual under 21 years of age.
New York’s Plan For Enforcing The New Smoking Age
The higher smoking age was hailed by health advocates, and the state Health Department said it plans to aggressively make sure that stores are enforcing the law.
The Health Department said it’s partnering with State Police to conduct undercover investigations under The Adolescent Tobacco Use Prevention Act, which enlists underage youth to attempt to buy tobacco and e-cigarettes.
It is also reaching out to local health departments and district offices to advise them of the change, as well as making sure all signs in stores reflect the age change.
New York law allows the state to criminally charge vendors who sell to underage customers, as well as impose civil penalties.
The new law allows the state to more easily enforce the age limit, advocates said.
Some counties already had raised the smoking age to 21, including New York City and Westchester and Rockland counties, making it difficult for enforcement across county lines.

“The Department of Health is using every tool at our disposal to prevent young people from developing lifelong and deadly nicotine addictions,” state Health Commissioner Dr. Howard Zucker said in a statement.
“This law will help keep cigarettes and vaping products from getting into the hands of people under 21 years of age and will ultimately save lives.

Vaping Cases At Forefront Of Store Owners’ Concerns In New York
The new law comes as New York and other states are trying to crack down on vaping use that has led to illnesses across the country.
New York has reported 165 lung injuries and one death associated with vaping, likely linked to black-market marijuana products.
In September, New York issued an emergency declaration prohibiting the sale of flavored vape liquids. But the ban has been delayed because of a court fight with the vaping industry.
So while the change in the smoking age is having a limited impact on business, the new stigma toward vaping products is causing a larger hit on their customer base, stores said.
“That is what’s killing businesses now, that people don’t trust us. We’ve worked 11 years without issue and without illness ever,” Manente said.
“Those products are from the black-market, they’re not nicotine products, they’re THC products. No kid is going to admit to smoking pot if they’re under-age.”

New York City Raises Base Price For Cigarettes To $13 A Pack
NEW YORK The cost of buying cigarettes in New York’s five boroughs just got a little more expensive.
According to the New York City Health Department, the base price for a pack of cigarettes ticked up to $13 on June 1. The price tag makes it the highest pack price in the United States.
The increase was set in motion this past August when city officials passed Local Law 145, which requires retailers to sell cigarettes for a minimum retail price of $13 per pack. The implementation date was set at June 1.
Mayor Bill de Blasio signed the increase into law as part of a seven-bill package aimed at tobacco regulation, as CSNews Onlinepreviously reported. The end goal is to reduce the number of smokers in the city by 160,000 by 2020.
“The cost of cigarettes is rising in New York City, and history shows that higher prices means fewer smokers,” said Health Commissioner Mary T. Bassett. “I’m thrilled we’re back on top with the highest pack price in the United States. Now is a great time to try to quit smoking, and our NYC Quits program can help. Even if you only smoke a few a day, or if you don’t smoke every day, the money adds up, and so does the risk to your health.”
The New York City Department of Consumer Affairs will enforce the minimum prices for cigarettes as a part of its regular inspections of licensed tobacco retailers.
Johnson introduced the series of tobacco measures along with council members Brad Lander, Fernando Cabrera, Ritchie Torres and James Vacca.
Require Vapor Product Manufacturers To Disclose Product Ingredients
Public Health Law Article 17 requires manufacturers of vapor products distributed, sold, or offered for sale in NYS, both retail or wholesale, to disclose the ingredients of vapor products, toxic metals in heating elements, and byproducts of the aerosol produced by the normal use of vaping products to the State Health Commissioner for public record and post these on their websites.

Cigarette Prices By State 2021
Cigarette prices per state vary between $5.25 and $12.85 per pack. With 20 cigarettes per pack, this ranges between $.26 and $.64 per cigarette.
Only two states are outliers, with cigarette prices above $10 per pack. Illinois charges $11.50 per pack, and New York charges $12.85 per pack. While both of these states have large populations, there is no correlation between state population and how much they charge for a pack of cigarettes.

Any business caught selling cigarettes for less than $13 will face fines starting at $1,000 for the first violation, according to the city Department of Health.

Cigarette Fire Safety Standards
Enacted in 2000 and implemented in 2004, the Cigarette Fire Safety Act, Executive Law Article 6-C Section 156-C, established fire safety standards for cigarettes sold in NYS. The act requires manufacturers to certify that all cigarettes they offer for sale in NYS meet a specific ignition propensity standard to prevent fires caused by burning cigarettes left unattended and particularly those held by smokers who fall asleep during use. NYS was the first jurisdiction in the world to establish such a requirement. Cigarette-caused fires and deaths have declined since the implementation of the law.
The Clean Indoor Air Act
Enacted in 1989 and last amended in 2019, Public Health Law, Article 13-E, known as the Clean Indoor Air Act prohibits the smoking of tobacco products and use of vapor products in nearly all indoor and certain outdoor public and workplaces. Exemptions are allowed for cigar bars in existence prior to December 31, 2002, for organizations that do not have employees, and for standalone vape shops that permit only the use of electronic cigarettes. New York is raising the legal age to purchase tobacco and electronic cigarettes from 18 to 21.
Cuomo said the bill aims to prevent young people from taking up smoking, as “irresponsible corporate marketing campaigns” target the youth.
“By raising the smoking age from 18 to 21, we can stop cigarettes and e-cigarettes from getting into the hands of young people in the first place and prevent an entire generation of New Yorkers from forming costly and potentially deadly addictions,” Cuomo said in a release.
Cuomo announced a plan to raise the minimum age to purchase tobacco products in January, citing data showing that tobacco use is the No. 1 cause of preventable death in the state and that an increasing number of underage youth are using traditional cigarettes and e-cigarettes.
The Democratic-controlled state Senate passed the bill in April, a month after the Democratic-controlled state Assembly passed it, the Democrat & Chronicle reported.
E-cigarettes are now the most commonly used tobacco product by youth in New York, and the rate of e-cigarette use by youth doubled between 2014 and 2016, according to the New York State Department of Health.
The New York State Department of Health also says about 35,000 high school students smoke, starting at an average age of 13.
Sixteen other states and Washington, D.C., have increased the legal age to purchase tobacco products to 21, according to the nonprofit organization Tobacco-Free Kids.
Supporting A Higher Smoking Age
Altria, the Virginia-based tobacco giant, has even supported the change in New York, saying it also wants to ensure underage people aren’t using their products.
We agree that the current trends in underage e-vapor use must be addressed,” the company said in a statement Monday.
“Tobacco harm reduction for adults cannot succeed without effective measures to reduce underage use of all tobacco products.”
Under the bill, retailers who sell tobacco products to anyone under 21 could be faced with a fine as high as $2,500 and face the revocation of their license to sell the items.
Cuomo said he will sign the bill.
“The lifelong health effects of tobacco cannot be overstated, and in New York we are committed to doing everything in our power to keep tobacco products out of the hands of young people,” Cuomo said in a statement Monday.

Why New York Increased The Smoking Age
Cuomo signed the bill into law, he said, as a way to improve the health of young adults.
Cuomo, a former smoker, said the earlier young people smoke, the more likely it will become a lifelong addiction.
According to the U.S. Surgeon General, 88% of adult smokers started using tobacco before age 18, and 90% of the people who purchase cigarettes for minors are between the ages of 18 and 20.
So by raising the age to 21, New York hopes to limit young people buying cigarettes for their underage friends.
“The goal of this law is simple: to prevent cigarettes and vaping products from getting into the hands of our youth, creating an addiction to a deadly habit,” Cuomo said in a statement.
Data from the state Health Department showed that youth smoking has largely switched from cigarettes to electronic cigarettes.
The state said nearly 40% of 12th grade students and 27% of high school students in New York indicated in recent surveys that are used e-cigarettes 160% higher than the usage rates five years ago.
At the same time, the high school student smoking rate dropped from 27% in 2000 to a record low of 4.3% in 2016.

As six armed officers pour out of two unmarked Ford Explorers on a Long Island City street corner, you can see the confusion on the faces of gawkers and passersby. One woman looks up from her phone and does a sitcom-worthy double-take when she notices their windbreakers, embossed with the word SHERIFF in big gold letters, front and back.
