Again, this is a reflection of company policy regarding banned states and not a legal determination by any arm of government. Inclusion on the list does not necessarily mean it is a state where DFS is illegal, and exclusion from the list also doesnt guarantee that fantasy sports is legal in the state.

So a state being on the list above isnt the same as being able to definitively claim that FanDuel is illegal in that state, and a state being off of the list isnt the same as being able to say FanDuel is legal in that state.

Legalization Of Sports Betting In Ny

Retail sports betting came to New York in 2019, and now mobile sports betting is expected by the 2022 Super Bowl after former Governor Andrew Cuomo signed it into law in April 2021. The state is expected to award licenses to sportsbooks in January 2022. Mobile sports betting would be live shortly after the licenses are awarded.

The RFA issued in July, referenced a minimum of two operators, opening up the possibility of more competition in New York State. These operators will be able to offer a minimum of 4 sportsbooks, known as skins.

Mobile Sports Betting In New York

As stakeholders debate the merits of legalized sports gambling in the Empire State, few topics have garnered as much controversy as mobile sports betting. Proponents argue that the industry is continually shifting to a mobile environment, one that is embraced by the Millennial generation. They point to figures in New Jersey, where mobile sports betting in some months has eclipsed 80 percent of the states handle. Cuomo has voiced strong opposition to any measure that would bring mobile sports betting to the state. Speaking to WAMC 90.3 FM in Albany, Cuomo downplayed the impact of mobile wagering in New Jersey as a revenue generator. While Addabbo projects that mobile sports wagering could bring New York $60 million licensing fees and an additional $30 million in annual tax revenue from the four casinos alone, Cuomo likened the proceeds to nothing more than a rounding error, in the New York state budget. Addabbo, meanwhile, has argued that a mobile component is so vital to the expansion of sports gambling that he insists sports betting is not viable in New York without mobile sports betting.

Legalization Effort In New York

On May 14, 2018, the US Supreme Court overturned PASPA, a 1992 bill restricting most states from offering legal sports betting. New York could then pass a bill legalizing sports betting.

Before that happened, New York Senate Racing, Gaming & Wagering Committee Chair John J. Bonacic sponsored a bill that would have established sports betting regulations ahead of the Supreme Court ruling. That bill was still active when he retired that same year, and State Senator Joseph Addabbo took over sponsorship of the bill when he became the new Committee Chair.

Despite Senator Addabbos efforts, mobile sports betting was not part of the deal. Instead, only retail sportsbooks in Upstate New York casinos could offer legal sports betting.

On July 16, 2019, Schenectadys Rivers Casino accepted the first legal sports bets, and seven additional retail sportsbooks have opened since. All the while, former Gov. Andrew Cuomo remained adamantly opposed to legalized online sports betting.

Then the coronavirus pandemic began. On top of a massive death toll, the states tax revenue dropped by more than $3 billion. To compensate for that, lawmakers proposed a budget proposal that legalized recreational marijuana use as well as online sports betting.

The Status Of Ny Online Sports Betting

Online sports betting could come to New York as soon as late 2021 or early 2022.

In 2021, Gov. Andrew Cuomo and state legislators negotiated for weeks on a deal to bring mobile NY sports betting into existence. That deal received legislative approval in April 2021 and could pave the way for betting in NY on mobile devices before long.

Gaming regulators will set up a request for proposals to allow sportsbooks to apply for a NY sports betting license. There will be at least four different sportsbook apps in New York after that process is complete, although the state could end up offering more.

After New Jersey won the Supreme Court sports betting case in May 2018, New York became free to move forward with single-game wagering. Efforts to pass a new sports betting law that included integrity fees for sports leagues died in June 2018 at the state legislature. However, Sen. Joseph Addabbo, chair of the Senate Racing, Wagering and Gaming Committee, introduced similar legislation for the 2019 session.

The New York State Gaming Commissiongave preliminary approval to rules and regulations in January 2019 and started allowing retail sportsbooks to go live in July 2019.
