Dear Majority Leader Schumer:

Thank you for your continued efforts to respond to the COVID-19 pandemic and your work to protect New Yorkers from the virus. Earlier this year as vaccine rollouts were underway, many of us were hopeful for a full and timely return to workplace normalcy this year. The unfortunate reality is that our communities are still struggling and the end of expanded pandemic unemployment benefits came at a perilous time. One thing is abundantly clear for those who have experienced the most hardship and loss during COVID-19, this pandemic is far from over. We are gravely concerned about the end of the Pandemic Unemployment Assistance , Pandemic Emergency Unemployment Compensation , and Federal Pandemic Unemployment Compensation , and request that the federal government provide additional funds to states who wish to continue those programs. Moreover, we request additional federal funding or forgiveness to cover some of New Yorks unemployment debt.

An estimated 7.5 million Americans lost their full benefits or supplemental benefits with the expiration of these programs, including 1.2 million New Yorkers. As of September 6th, 745,548 New Yorkers were receiving PUA. These New Yorkers have been left without any support. An additional 474,402 New Yorkers were receiving FPUC and have lost vital supplemental funds they received each week.

Unemployment Extended Benefits Program

The federal government may provide additional benefits to people who have exhausted unemployment benefits. There are additional weeks of federally funded Extended Benefits in states with high unemployment rates.

Unemployed workers are eligible for up to 13 or 20 weeks of additional unemployment benefits, depending on state laws, and the unemployment rate.

These benefits are paid through the state unemployment departments, and eligibility would start when all other benefits are exhausted. If you’re eligible, your state unemployment office will notify you.

Eligibility requirements vary by state, so be sure to check the FAQ section of your state unemployment website for details.

I Am About To Exhaust My Regular Unemployment Compensation Benefits What Kinds Of Relief Does The Cares Act Provide For Me

Under the CARES Act states are permitted to extend unemployment benefits by up to 13 weeks under the new Pandemic Emergency Unemployment Compensation program. PEUC benefits are available for weeks of unemployment beginning after your state implements the new program and ending with weeks of unemployment ending on or before December 31, 2020. The program covers most individuals who have exhausted all rights to regular unemployment compensation under state or federal law and who are able to work, available for work, and actively seeking work as defined by state law. Importantly, the CARES Act gives states flexibility in determining whether you are actively seeking work if you are unable to search for work because of COVID-19, including because of illness, quarantine, or movement restrictions.

In addition, if you have exhausted the 13 weeks of additional benefits available under the PEUC program, you may be eligible to continue receiving benefits under the PUA program. PUA benefits are available for a period of unemployment of up to 39 weeks, meaning that if you have exhausted regular UC and PEUC benefits in fewer than 39 weeks, you may be eligible to receive assistance under PUA for the remaining weeks within PUAs 39 week period.

Some States Are Waiting For More Guidance Which Just Came

None of the states that Insider heard from committed to extending unemployment benefits but several said they were awaiting more guidance on how to potentially distribute their stimulus benefits to jobless workers.

“Leading up to the expiration of this temporary unemployment insurance, the Administration will continue to review guidance from the Treasury Department and consider all possible options and resources, including the use of ARPA and other funds, to continue supporting Rhode Islanders and small businesses,” a spokesperson for Rhode Island’s governor said in a statement to Insider.

California responded similarly, saying that they “are reviewing the letter from Treasury Secretary Yellen and Labor Secretary Walsh to Congress and look forward to examining any additional legal guidance to states from U.S. Department of Labor.” California has also proactively announced rent, food, and housing assistance to help unemployed workers who were cut off, which have been bolstered by stimulus funds.

Arindrajit Dube, an economics professor at University of Massachusetts Amherst and a leading scholar on unemployment benefits and the minimum wage, wrote in an email to Insider that states should take advantage of those stimulus funds to aid workers.

To receive unemployment insurance benefits, you need to file a claim with the unemployment insurance program in the state where you worked. Depending on the state, claims may be filed in person, by telephone, or online.

I Am An Independent Contractor Am I Eligible For Unemployment Benefits Under The Cares Act

You may be eligible for unemployment benefits, depending on your personal circumstances and how your state chooses to implement the CARES Act. States are permitted to provide Pandemic Unemployment Assistance to individuals who are self-employed, seeking part-time employment, or who otherwise would not qualify for regular unemployment compensation. To qualify for PUA benefits, you must not be eligible for regular unemployment benefits and be unemployed, partially unemployed, or unable or unavailable to work because of certain health or economic consequences of the COVID-19 pandemic.

The PUA program provides up to 39 weeks of benefits, which are available retroactively starting with weeks of unemployment beginning on or after January 27, 2020, and ending on or before December 31, 2020. The amount of benefits paid out will vary by state and are calculated based on the weekly benefit amounts provided under a states unemployment insurance laws. Under the CARES Act, the WBA may be supplemented by the additional unemployment assistance provided under the Act.

No. As a general matter, individuals receiving regular unemployment compensation must act upon any referral to suitable employment and must accept any offer of suitable employment. Barring unusual circumstances, a request that a furloughed employee return to his or her job very likely constitutes an offer of suitable employment that the employee must accept.

While eligibility for PUA does not turn on whether an individual is actively seeking work, it does require that the individual be unemployed, partially employed, or unable or unavailable to work due to certain circumstances that are a direct result of COVID-19 or the COVID-19 public health emergency. In the situation outlined here, an employee who had been furloughed because his or her employer has closed the place of employment would potentially be eligible for PUA while the employer remained closed, assuming the closure was a direct result of the COVID-19 public health emergency and other qualifying conditions are satisfied. However, as soon as the business reopens and the employee is recalled for work, as in the example above, eligibility for PUA would cease unless the individual could identify some other qualifying circumstance outlined in the CARES Act.

If I Am Eligible For Pandemic Unemployment Assistance Do I Need To First Apply For Unemployment Insurance

States must have a process for determining that Pandemic Unemployment Assistance applicants are ineligible for regular unemployment benefits, which may not include filing a regular claim as a first step. States are not required to take and adjudicate a full claim for regular unemployment insurance benefits to meet this requirement. While states are not prohibited from taking a full claim, to facilitate expedited claims processing the U.S. Department of Labor has discouraged states from doing so. Individuals should apply using the states PUA application process and, in states that have not yet established that process, must wait until it is established.

New York can take precautionary measures now to protect unemployed residents in the event that Congress allows federal unemployment insurance programs to expire on Labor Day. This can be done by the State Legislature passing a bill that ensures the states Extended Benefits program remains in place under the total unemployment rate activation trigger when 50% state funding is required.

Right now, of the nine states with their Extended Benefits programs turned on, only four will continue beyond Labor Day. The majority of these state programs will shut down because the federal government will resume covering half the cost instead of providing full funding.

While neighboring states Connecticut and New Jersey will rightfully keep supporting long-term unemployed workers through the pandemic recovery, New York will have its Extended Benefits program shut off.

That is unless legislators, in concert with incoming Governor Kathy Hochul, work to keep the program active.

According to the most recent U.S. Department of Labor numbers, 725,000 New Yorkers were enrolled in the federal Pandemic Emergency Unemployment Compensation program and 10,000 in the states Extended Benefits program the week ending July 31. The way that these programs function is that workers exhausting their PEUC benefits transition onto EB. However, if the state EB program also turns off on September 6, hundreds of thousands unemployed New Yorkers will lose a key source of income.

You will only qualify for the EB unemployment extension if you have used up all of your regular unemployment benefits and also used up all of your EUC08 unemployment extension.
