Types Of Disability Policies

There are two types of disability policies.

  • Short-term policies may pay for up to two years. Most last for a few months to a year.

  • Long-term policies may pay benefits for a few years or until the disability ends.

Employers who offer coverage may provide short-term coverage, long-term coverage, or both.

New Yorkers who are no longer employed have the option of requesting unemployment benefits through the New York State Department of Labor . New York unemployment is usually referred to as unemployment insurance . However, unemployment insurance coverage is not guaranteed for all unemployed residents within the state. In order to claim unemployment benefits in New York, former employees must meet the eligibility requirements determined by the NYSDOL. Applicants who are granted NY unemployment insurance benefits are required to continue meeting weekly eligibility requirements in order to continue receiving aid for the duration of the EDD unemployment coverage period.

NY residents can receive unemployment insurance benefits for up to 26 weeks if they meet the eligibility requirements. Once your benefit period ends, you may be able to apply for a federal unemployment benefits extension if the state is currently experiencing high unemployment rates. Furthermore, state and federal taxes may be taken out of New York unemployment benefits claims upon a claimants request. Overview Of New York State Unemployment Insurance

To be eligible to receive unemployment in the state of New York, you must lose your job as a result of events that are not your fault. In other words, if you were fired from your job due to poor performance, you will not be eligible for unemployment in New York. You should file a claim for unemployment within the first week that you lose your job to begin receiving benefits as soon as possible.

For a new unemployment claim, you will need to apply for benefits on the day of the week that corresponds to the first letter of your last name according to the following scheme:

â Letters A through F file on Mondays

â Letters G through N file on Tuesdays

â Letters O-Z file on Wednesdays

Individuals who missed the correct day of the week must file on Thursday through Sunday as soon as possible after they become unemployed. When you file a claim during the first week following unemployment, the claim that you file will be backdated to reflect the date when you officially became unemployed and if youâre eligible to receive unemployment benefits, you will be paid from that date onward. If you file your claim late, you can contact the Department of Labor via fax or snail mail to request benefits for the time period when you were unemployed but not receiving benefits. We discuss late claims and the filing requirements you must follow to get reimbursed for back weeks later on in this guide.

The unemployment benefits program in the state of New York is managed by the New York Department of Labor .

The unemployment benefits program in New York is called Unemployment Insurance.

By law, the unemployment insurance program provides benefits to people who:

  • Have enough employment to establish a claim
  • Have lost employment through no fault of their own
  • Are ready, willing and able to work and
  • Are actively seeking work

Find New York Unemployment Appealing Denied Benefits Information

Former employees who have been denied unemployment benefits can request an unemployment denial appeal to argue their case. If you win your appeal, the New York State Department of Labor will grant you the employment insurance you are entitled to. Residents who have been denied unemployment benefits will receive a Notice of Determination via mail indicating the reasons for which they are not considered eligible to earn unemployment aid. This notice will also state for which period of time benefits are being denied as well as the steps to re-qualify or ask for a hearing with the NYSDOL. Denied claimants can begin the appeal application process through the NYSDOL.

The request to appeal a decision must be filed or postmarked within 30 days of the date you received the initial notice of determination. Filing a request for reconsideration will grant residents who have had their unemployment compensation benefits denied a hearing before an administrative law judge. If the initial appeal is denied, you may file a follow-up appeal with the Unemployment Insurance Appeal Board within 20 days of the administrative law judges decision. If New York residents have been subject to wrongful termination, the UI Appeal Board may change its original decision for denial.

Are You Out Of Work Through No Fault Of Your Own

You must be out of work through no fault of your own to qualify for unemployment compensation in New York. If you are laid off, lose your job in a reduction-in-force , or get “downsized” for economic reasons, you will meet this requirement. You will also likely be eligible for unemployment benefits if you are fired because you don’t meet the qualifications for the job or you fail to meet the employer’s performance or productivity standards.

In New York, employees who are fired for work-related misconduct may not qualify for unemployment benefits. Examples of work-related misconduct include violating company policy or rules, such as those prohibiting absenteeism or insubordination. If you are fired for conviction of a felony , you also won’t be eligible for benefits.

If you quit your job, you won’t be eligible for unemployment unless you had good cause for quitting.

How New York Unemployment Benefits Extension Works

Unemployed claimants reaching the end of their claim may be wondering, How can I extend unemployment benefits? as standard payments end after a maximum of 26 weeks. Unemployment extensions in New York are only available during certain times and under specific circumstances. Federal unemployment extensions provide additional periods of benefits payments during times of unusually high unemployment. Claimants who depleted their unemployment benefits have conditions they must meet before establishing a new claim. They must gain new employment , earn 10 times the benefit rate, and they can only file a new claim once the benefit year in which they collected has ended. The same provisions are required for those denied eligibility due to resignation, termination or refusal of new work opportunities.

How Much Might I Get

New York determines the amount of your weekly unemployment benefit by reviewing earnings during whats known as a base period. New Yorks basic base period covers your wages for the first four calendar quarters before the quarter in which you file for unemployment.

To qualify for unemployment insurance benefits, you must meet all of these earnings requirements for the base period.

  • Earned wages at jobs covered by unemployment insurance in at least two calendar quarters
  • Received payment of at least $2,600 in one calendar quarter
  • Received total wages that are at least 1.5 times the amount of wages earned in your highest quarter

Your weekly benefit rate will be 1/26 of the high-quarter wages you earned in your base period. For example, if your wages during the base period were $4,394, the state would divide that amount by 26 to calculate your weekly payment amount of $169.

Weekly unemployment benefits in New York range from $104 to $504 for claims effective Jan. 6, 2020, or later. Again, because states may change their benefits during times of crisis, its possible these maximums can change during recessions or other difficult economic situations.

How To File For Section 599 With New York State Unemployment

The Section 599 program allows an unemployment claimant receiving training to keep his benefits without following the job search requirements that go along with unemployment in New York. Training may consist of vocational or educational classes and must improve the claimant’s chances of finding long-term employment after completion. All training programs must earn approval from the New York State Department of Labor, and the claimant has to submit a request to the department for consideration for the program.

Locate the Division of Employment and Workforce Solutions office near you. Go to the New York State Department of Labor’s official website for a list of office locations .

File the forms in the office. You will receive notice of approval or denial of the request by mail from the labor department.

In March, the CARES Act was signed into law with millions of Americans receiving stimulus checks. The unemployment rate rose substantially since the beginning of the outbreak and the US have also been providing increased benefits to those who have lost their jobs.

Some states, such as New York, have been hit particularly hard by the coronavirus and unemployment as a result. Tens of thousands of New York residents have been scrambling to apply for various benefits and with everything that is going on, some did not claim on time.

According to New York’s website, “an unemployment week runs Monday through Sunday. If you wish to claim benefits for a week of unemployment, you have from the Sunday date at the end of that week through the next Saturday to do so.”

How Can I Apply

The best way to file a new unemployment insurance claim in New York is through the state department of labors online portal. The day of the week to apply is based on the first letter of your last name, and youll need a NY.gov ID to sign into the portal. If you dont already have a NY.gov account, you can create one through the department of labors online services page. But if you already applied for unemployment by phone, youll need to wait at least one business day before creating an online account.

You can also call the claim center at 1-888-209-8124 during the agencys COVID-19 expanded hours of 8 a.m. to 7:30 p.m. Monday through Friday and 7:30 a.m. to 8 p.m. on Saturday and Sunday Eastern time.

Whether you apply online or by phone, youll need to provide some basic information, which includes

  • Social Security number
  • Drivers license or motor vehicle ID card number

How Much Will You Be Paid By Unemployment Each Week When Will Your New York Unemployment Claim Be Processed And Paid

To calculate the amount of the benefit you are entitled to, the state of New York unemployment process uses one of two possible base periods. Base periods are divided into calendar quarters and the quarter you were paid the highest amount of wages determines the amount of your New York unemployment weekly claims. While you can determine ahead of time how much New York unemployment compensation you receive, you will be formally notified before your benefits begin.

New Yorks Basic Base Period is the first four of the last five completed calendar quarters prior to the beginning date of the UI claim. If you have earned enough wages in your Basic Base Period, those wages will be used to calculate your benefit amount.

If you do not have enough wages in the Basic Base Period to establish a claim, you may be able to use an Alternate Base Period. It is the last four completed calendar quarters prior to the beginning of the claim.

If you have enough wages in the Basic Base Period, the state will not automatically check to see if your benefit amount would be higher in the Alternate Base Period. If you think your New York unemployment amount would be higher, you can request that the state use your Alternate Base Period instead.
