If the application of New York law provided a more favorable result to the borrower, then the New York law would apply. Thus, each situation should be analyzed in light of both the applicable federal and state laws in order to determine which is applicable.
The following hypothetical loan transactions were presented to demonstrate the fact that in certain circumstances applying the provisions of the federal Homeowners Protection Act of 1998 would be more favorable to the borrower than following the applicable provisions of N.Y. Ins. Law §6503 :
A house with a $530,000 appraised value sells for $500,000. The lender loans the purchaser 90% of the purchase price.
A house with an appraised value of $240,000 sells for $260,000. The lender loans the purchaser 95% of the appraised value.
New York law and federal law both contain statutes that address the issue of the termination of PMI. N.Y. Ins. Law §6503 provides as follows:
the cost to mortgagors and the necessity of maintaining insurance
the need in light of prevailing economic conditions for regulated mortgage investors to resell such security.
How Do I Get Rid Of Pmi
Fortunately, there are a few ways to eventually get rid of PMI if youre required to pay it now. The first is consistently making payments until you have 20% equity in your homeor an LTV of 80%at which point the lender is required to cancel it. However, this doesnt happen automatically you should contact your lender and ensure that PMI is indeed canceled once you meet the qualifications.
Another situation in which you no longer need to pay PMI is if your home value increases and you now have more than 20% equity built up. In this situation, your LTV might reach 80% faster than you were originally required to pay PMI. If that happens, great. You should have your home reappraised, and if you owe less than 80% of the newly appraised value, its time to get in touch with your lender to have your PMI canceled. Keep in mind that you are responsible for the costs associated with having your home appraised in this situation.
Finally, if your cash flow has unexpectedly increased and you can afford to pay off your mortgage faster, you may consider doing soat least for a few months. By making extra payments toward your loan, you can pay down the principal faster and reach an LTV of 80% sooner than originally planned.
Cancelling Pmi On A Multi
If you have a multi-unit primary property or investment property, things work a little bit differently.
Fannie Mae lets you request cancellation of your PMI once you reach 30% equity, while Freddie Mac requires 35% equity.

PMI can be requested to be removed in writing, but will only be canceled if the below criteria have been met:
- Your mortgage principal balance has reached less than 80% of the loans balance or of the homes current value.
- You make consistent and timely payments. Mortgage payments cannot be 30 days late within one year of cancellation request or 60 days late within 2 years.
- Your loan must be current with payments.
- You must verify that you do not have any second mortgages.
You may need to submit proof upon the lenders request such as a history of timely payments and not having a second mortgage.
