The plaintiffs, certified home health aides, allege in their amended complaint that the defendants misappropriated employee benefit plan assets in violation of the New York Home Care Worker Wage Parity Act, N.Y. Public Health Law § 3614-c , and the Employee Retirement Income Security Act of 1974, 29 U.S.C. § 1001et seq. . On February 13, 2020, I stayed the litigation pending the Supreme Court’s decision in Thole v. U.S. Bank. On June 1, 2020, the Supreme Court ruled that participants in a defined-benefit retirement plan did not have Article III standing to challenge the management of that plan. Thole v. U.S. Bank N.A., 140 S. Ct. 1615 . Before the Court is the defendants’ motion to dismiss the plaintiffs’ ERISA and Wage Parity Law claims. For the reasons that follow, I grant the motion to dismiss the plaintiffs’ ERISA claims and decline to exercise jurisdiction over the remaining state law claim.
On February 13, 2020, I granted the plaintiff’s motion to strike the HealthCap defendants’ motion to dismiss.

We recently spoke with Raizy Weiss, COO of Preferred Home Care of New York. Founded in 2007, Preferred is one of New Yorks largest home care agencies, serving over 8,000 patients. Raizy tells us all about how she was able to grow her business, what keeps her focused, and why she wants women to speak up.
What brought you to the home care industry?
For my husband Berry, it was always about being able to provide jobs for people. He wanted to help people pay their bills and put food on the table for their families. With my passion for helping people and his passion for providing jobs, we agreed lets do it!
