The Social Security Administration announced on Wednesday that people will now be allowed to select the sex that best aligns with their gender identity in records, a policy change intended to be more inclusive of transgender Americans.

The agency said it would now accept peoples self-identified gender identity of male or female, even if their identity documents show otherwise, and it is exploring a future policy that would allow for an X sex designation for people who do not identify as either male or female. The Social Security Administration had promised in March that the new policy would be in effect by fall.

The acting commissioner of the agency, Kilolo Kijakazi, said in a news release that the new policy demonstrated a commitment to decrease administrative burdens and ensure people who identify as gender diverse or transgender have options in the Social Security Number card application process.

The Biden administration has also sought to make its federal forms of identification, applications for federal programs and travel documents more inclusive for Americans who identify as transgender or nonbinary by making the X option widely available.

If it does, you will need to find out whether the state you were born in, requires an application or a court order to change your gender designation on your birth certificate.

Updating Gender Identity In The Eyes Of The Law

Increasingly, people around the world have grown increasingly confident in their ability to confirm the gender they identify with may not always be the same as the sex assigned to them at birth. Unfortunately, continuing to use the same identifiers for gender as they were given at birth can cause significant discomfort and emotional distress for some individuals. This is why its important for people in New York to have the opportunity to update their gender identity on their own or with the help of a family law attorney.

The Gender Recognition Act introduced in 2021 specifically provides a mechanism New Yorkers can petition the court for leave to adjust their sex designation. This petition can be made by an individual at the same time as a name change petition, or separately. In the case of minors, its also possible for a petition to change the sex designation of a child to be brought to the courts by a parent on the minors behalf.

According to the official guidelines of the Gender Recognition Act, the Civil Rights law in place up until 2021 was to be amended to add a new article, known as 6-A. This article provides the court shall issue an order allowing the petitioner to assume their proposed new sex designation and amend their sex identifier on requested identification documents using self-attestation.

Who Keeps Track Of Birth Certificates

Each state has its own Department of Vital Statistics, which holds important records for the state. This includes birth and death certificates, marriage licenses, and divorce records. The National Center for Health Statistics, or NCHS, works with individual states to collect birth statistics into the National Vital Statistics System.

This specific project provides information on birth certificates collected through standard forms created by the aforementioned to collect relevant birth data. The NCHS and each state share expenses for providing such data for national use.

Simply put, birth certificates are issued at the state level. Each state is legally bound to report all annual vital statistics data to the federal government. Nevertheless, if a baby is born to American parents while overseas, the U.S. Department of State is accountable for collecting that info.
