If the parent or legal guardian is simultaneously requesting that the minor’s name be changed on their birth certificate, that should be noted on the application. The application must then include a copy of a court order authorizing the name change.

Born In New York State But Outside Of New York City

If you were born in New York State but outside of New York City, you can ask to change your name and gender designation at the same time. The DIY Name Change program for New York State Residents filing in New York State Supreme Court or County Court is the easiest way to prepare the paperwork.

Visit the Name Change and/or Sex Designation Change Forms page to use the DIY Form Program. You will receive the paperwork for the name change along with instructions and the Application for Correction of Certificate of Birth for Gender Designation.

If you choose to ask for you name change first, wait until your name change have been approved and you have a signed Court Order for your name change before completing the Application for Correction of Certificate of Birth for Gender Designation.

The Social Security Administration announced on Wednesday that people will now be allowed to select the sex that best aligns with their gender identity in records, a policy change intended to be more inclusive of transgender Americans.

The agency said it would now accept peoples self-identified gender identity of male or female, even if their identity documents show otherwise, and it is exploring a future policy that would allow for an X sex designation for people who do not identify as either male or female. The Social Security Administration had promised in March that the new policy would be in effect by fall.

The acting commissioner of the agency, Kilolo Kijakazi, said in a news release that the new policy demonstrated a commitment to decrease administrative burdens and ensure people who identify as gender diverse or transgender have options in the Social Security Number card application process.

The Biden administration has also sought to make its federal forms of identification, applications for federal programs and travel documents more inclusive for Americans who identify as transgender or nonbinary by making the X option widely available.

If the applicant is filing while in prison, then they must submit it through the state legal system and will be reviewed by the court. If the applicant is also filing for a name change, they must fill out separate paperwork and petition for a court order to change their name.

The Gender Recognition Act introduced in 2021 specifically provides a mechanism New Yorkers can petition the court for leave to adjust their sex designation. According to the official guidelines of the Gender Recognition Act, the Civil Rights law in place up until 2021 was to be amended to add a new article, known as 6-A. This article provides the court shall issue an order allowing the petitioner to assume their proposed new sex designation and amend their sex identifier on requested identification documents using self-attestation.

Selecting Your Gender Marker

You can select the gender marker you would like printed on your U.S. passport. The gender you select does not need to match the gender on your supporting documentation such as a birth certificate, previous passport, or state ID. We no longer require medical documentation to change the gender marker on your U.S. passport.

At this time, you can select male , female , or unspecified or another gender identity as your gender marker if you are applying for a U.S. passport book and selecting routine service. You can apply in-person at a passport acceptance facility or renew by mail.

Beginning in late 2023, you will be able to select X as a marker if you are requesting expedited or urgent travel service. You will also be able to request for the following documents we issue:

  • Emergency passports printed at embassies and consulates
  • Consular Reports of Birth Abroad

To help people clear these hurdles, the IDP provides resources, education, and financial assistance to TGNCI New Yorkers as document holders seek to update and procure documents with names and gender identifications that align with their identities.

Someone doesnt have to think twice about showing their ID when theyre going to a bar, Nuovo says. It also makes life better because no longer a constant reminder of something that doesnt feel like themselves.

The NYU Law students who participate in IDP receive training to become advocates and are then matched with clients based on the clients needs. According to IDP, currently 51 advocates are assigned to cases.

New Yorkers Can Now Choose X Gender Marker On Their State Id

New York residents will now have the option to choose “X” as their gender marker on their state-issued IDs, Governor Kathy Hochul announced Friday.

The change applies to driver’s licenses, learner permits and non-driver IDs. The new policy was rolled out just days before the start of Pride Month and is part of New York’s Gender Recognition Act, which will go into effect on June 24.

“Every person, regardless of their gender identity or expression, deserves to have an identity document that reflects who they are,” New York Gov. Kathy Hochul said. “My administration remains committed to ensuring that New York is a place of value, love and belonging for members of the LGBTQ+ community.”

New Yorkers: You can now choose X as a gender marker on your driver license. Every person deserves to have an identity document that reflects who they are. This is a historic change in our fight to make New York a more inclusive and just state for all.

New York residents who already have a state-issued ID will have the option to change their gender marker from “M” or “F” to “X” at the DMV. Those applying for a state-issued ID for the first time will also have the option to select “X.”

An online application to request the change will be available beginning in July, Hochul said.
