How To Seal Your Record
As you can tell, most criminal records are automatically sealed after the appropriate time limit has passed. But better safe than sorry try obtaining a copy of your rap sheet to be sure. You can request a copy from the Division of Criminal Justice Services online.
If there are offenses on your rap sheet you’d like sealed, you’ll have to file a motion with the court. Contact the clerk’s office of the court where the charge was filed and prosecuted. Fill out the petition to seal records form, and feel free to ask the clerk for assistance. Case and arrest details, as well as proof of completion of any required rehabilitation program, must be provided.
If the court approves your petition, it will be entered into the record and the clerk will inform you. All records will be sealed at this time. If the court challenges your petition, you may need to provide more information, go to court, and offer greater detail and proof that your records should be sealed.
What Does It Mean When Information Is Sealed
As mentioned above, New York does not expunge or remove information from an individuals criminal record and as a result there will always be an unsuppressed version of your criminal record that is held by the Department of Criminal Justice Services . However, certain records can be sealed, meaning that they cannot be seen on your criminal history when it is requested by an agency or employer. Some records are automatically sealed, while others require judicial action to seal them.
First lets begin with records that are automatically sealed. Any arrest that did not result in a plea of guilty to or conviction of a crime will be automatically sealed. This includes cases where:
- An individual was found not guilty at trial
- The judge dismissed the charges
- After the arrest the prosecutor or police decided not to file charges
- An individual entered a plea of guilty to or was convicted of a violation such as traffic tickets, unlawful possession of marijuana, or driving while ability impaired
- The charges were adjourned in contemplation of dismissal

Sealing Drug Crimes In New York
Drug-related misdemeanor and felony offenses in New York can be sealed, provided the individual completes a Judicial Diversion Program, DTAP , or a similar substance abuse treatment program recognized by the court. How Many Crimes Can I Have Sealed In New York
New York only allows a person to seal their criminal record if it has two or less criminal convictions on it. In addition, only one of those convictions can be for a felony. Moreover, any felony on the above-mentioned list is not eligible to be sealed.
A person with more than two criminal convictions can still have their record sealed if the charges are related to only one or two criminal incidents.

You may use your Personal Record Review response for any personal reason.
An employer or licensing entity cannot ask you to provide this information as a condition of obtaining or continuing a job or holding a license: this is prohibited by New York State Labor Law. This law does not apply to: employees of state or municipal departments employees of legally incorporated hospitals, and employees of medical colleges associated with such hospitals and employees of private proprietary hospitals.
Access to criminal history records for employment or licensing is only permitted if there is a state law, federal law, or local law of a New York State village, town, city or county that specifically authorizes a fingerprint-based criminal history record check for employment or licensure.
State Labor Law also requires every employer to post a copy of New York State Correction Law Article 23-A, which deals with the licensing and employment of individuals convicted of crimes. The information must be posted in a place accessible to employees.

The New York Office of Court Administration provides public access to criminal records for convictions and arrests that occurred in New York State. For a fee an individual, agency, or private company can search convictions and open/pending criminal cases originating from County/Supreme, City, Town and Village courts of all 62 counties in New York. The only information that is needed to search someones criminal history under this method is their exact name and date of birth.
An Office of Court Administration criminal history search will reveal pending charges, misdemeanor convictions, felony convictions, and arrests that resulted in a conviction. An Office of Court Administration criminal history search will never reveal records that have been sealed.
