How To Get A New York State Real Estate License

Does New York Have Real Estate License Reciprocity With Any Other States

How to get your Real Estate License in New York State

New York has reciprocity agreements with Arkansas, Colorado, Connecticut, Georgia, Massachusetts, Mississippi, Oklahoma, Pennsylvania, and West Virginia.New York agents should learn as much as they can about reciprocity to streamline the application process. Applicants can also visit the New York Department of State website for more information.

Types Of Reciprocity Agreements

Reciprocity is state-specific, so the rules and requirements for reciprocity are unique in every state. However, there are generally three different types of reciprocity agreements, as follows:

  • No reciprocity: States that deny reciprocity to all out-of-state licensees
  • Partial reciprocity: States that require limited education and examination for agents from only certain reciprocal states.
  • Full reciprocity: States that allow you to transfer your real estate license from any state, typically requiring completion of the state portion of the real estate exam.
No Reciprocity
  • Virginia
  • Washington

We go into more detail about each states individual reciprocity agreements at the end of this article. Reciprocity agreements offer the greatest benefit for agents who are permanently moving to another state or are in proximity to two states: for example, New York and New Jersey. Agents who have no intention of moving to another state but want to still be able to conduct the occasional out-of-state real estate transactions are more affected by portability laws.

Is My Real Estate License Valid Everywhere In The Us

No. Every state has different regulations about obtaining and maintaining a Real Estate license. In other words, there is no such thing as a general US Real Estate license.

However, some states have what is called reciprocity between them. Reciprocity means that obtaining a Real Estate License in one state will make the same license valid in another state. In most cases, the reciprocity allows the Real Estate Agent to skip through all the pre-licensing work and take only the state-specific portion of the exam. The process varies by state, but in many states, you simply need to complete a reciprocal license application with the state in which you are seeking your license.

You should check for your states real estate license reciprocity policy if youre moving from one state to another it may save you having to start entirely from scratch in your education and testing requirements. These details are included on the state specific page on this website.

But Theres Hope In The Form Of A Certificate

New York officials arenât complete hard asses. Even with a felony on your criminal record, it may still be possible to get a real estate license if you can obtain a Certificate of Relief From Disabilities or a Certificate of Good Conduct.

A Certificate of Relief From Disabilities is used when you only have one felony on your record.

A Certificate of Good Conduct is used by those who have two or more separate felonies. If you were convicted of a class A or B felony you must wait for 5 years after incarceration/conviction and 3 years after a C, D or E felony to receive a Certificate of Good Conduct.

The certificates are granted by the Department of Corrections and Community Supervision . Both restore your legal right to apply for a real estate license in New York. You can also overcome a felony conviction if youâre able to get an executive pardon from the governor, but that will take some serious string pulling.

Keep in mind the Secretary of State could still decide to deny your license even if youâre able to get one of the certificates above. Youâre also not in the clear once you receive a license. If you are a licensed broker or salesperson and are convicted of a felony anywhere in the U.S. you must send the Department of State a certified copy of the judgment within five days. At that point, your license will be revoked.

Research Your States Licensing And Education Requirements

First, get your bearings. The requirements for pre-licensing courses and licensing applications are different in every state. Check with your real estate commission to understand what’s required to obtain your license.

Most states require:

  • College-level education on real estate basics including titles, deeds, contracts, and property ownership
  • Permanent residency in the state of the license application
  • Minimum age of 18 years or older
  • Criminal background check

Classes are available in person and online, but your courses and school must be approved by your state’s real estate licensing authority. Before you pay for a real estate school, make sure it’s accredited and acknowledged by your state.

Real Estate License Reciprocity

If you’re already a licensed real estate agent whos moving across state lines, see if your new state has a reciprocity agreement with the state where your license was issued. If a reciprocity agreement exists, you may already meet the pre-licensing requirements. This doesn’t mean you don’t need a license in your new state but you might be able to skip a step or two in the licensing process.

For example, Idaho has reciprocity agreements with Wyoming, Oregon, and Montana. If you have an Idaho real estate license, you’re not required to take real estate pre-licensing courses if you’re applying for a license in one of the other three states. You are, however, required to take state-specific portions of the exam in Wyoming, Oregon, and Montana.

Do Your Homework Understand Your States Education Requirements

This is going to be your first step towards getting your real estate license. Depending on which state you live in, you will have to fulfill different requirements. Usually, states require a minimum of 60 to 90 hours of real estate principles. These courses might include topics such as:

article 12-A, citizenship requirements, dual license, reciprocity, kickback, commingling, conversion, net listing, revocation or suspension of license, unlicensed assistants, property condition disclosure, stigmatized property disclosure, how to form a agency, fiduciary, principal, client, what is fiduciary duties, riparian rights, littoral rights, fixture, trade fixtures, fee simple, freehold, non-freehold, leasehold, life estate, estate in remainder, estate in reversion, severalty, tenancy by the entirety, tenancy in common, joint tenancy, community property rights, trustee, beneficiary, specific lien, general lien, mechanics lien, subordination agreement, easement in gross, dominant tenement, encroachment, appurtenances, grantor, grantee, etc.

These courses are available online and in-person, but whichever school you choose to take these courses from, make sure that it is properly accredited from your states real estate licensing commission. The process is much easier if you are a licensed agent in another state. If that is the case, then all you need to do is check for the reciprocity between your old and new state.
