The New York State OCA allows the public to perform a criminal record search in order to obtain criminal records. Online applicants may submit their applications on the Direct Access page. The search fee is $95 and they will receive the result of their search by email the following business day.
In-person or mail-in applicants may perform a criminal record search by completing a Criminal History Record Search Application Form. Applicants must include their name, address, phone number, and other related information, then fill out the full name and date of birth of the criminal history record sought. The applicant must attach the $95 fee and submit the package in person or by mail to:

- If an individual is applying for a pistol permit.
Individuals who are satisfied with the confidentiality that record sealing already provides are not required to apply for expungement or destruction of conviction records.

You may use your Personal Record Review response for any personal reason.
An employer or licensing entity cannot ask you to provide this information as a condition of obtaining or continuing a job or holding a license: this is prohibited by New York State Labor Law. This law does not apply to: employees of state or municipal departments employees of legally incorporated hospitals, and employees of medical colleges associated with such hospitals and employees of private proprietary hospitals.
Access to criminal history records for employment or licensing is only permitted if there is a state law, federal law, or local law of a New York State village, town, city or county that specifically authorizes a fingerprint-based criminal history record check for employment or licensure.
State Labor Law also requires every employer to post a copy of New York State Correction Law Article 23-A, which deals with the licensing and employment of individuals convicted of crimes. The information must be posted in a place accessible to employees.

Noncriminal Justice Volunteer Background Checks / Volunteer Care Provider Program :
N.J.A.C. 13:59-1 et seq. provides background checks for non-criminal justice volunteers to the following:
- Any person who volunteers with a qualified entity, as that term is defined by the National Child Protection Act of 1993, 42 U.S.C. §§ 5119, 5119c
- Any person who volunteers his or her services to an entity that has been qualified by the Internal Revenue System as exempt from Federal income tax pursuant to 26 U.S.C. § 501 or
- Any volunteer of a nonprofit youth serving organization.
There are two options available to a requester under the VCP.
Fingerprint-Based VCP Check :
A requester may elect to conduct a more thorough check, based on a fingerprint comparison by using the service code provided below. The fee for electronic fingerprinting is $32.13. These responses will be mailed directly to the employers address that is provided by the applicant. The following forms of payment are accepted: VISA, Master Card, American Express, Discover prepaid debit cards, or electronic debit from a checking account. Accounts will be debited immediately.
YOUR EMPLOYER / VOLUNTEER ORGANIZATION ADDRESS MUST BE COMPLETE AND ACCURATE, AS RESULTS ARE SENT OUT VIA US MAIL.

Whats On An Inmate Record
New York is similar to other states in what it has on an inmate record. Once a requester gets an inmate record, they will have the following information:
- Basic personal information like the name, a birthdate and the gender
- A mug shot and inmate location
- An inmate registration number and jail transfer information
- Custody status
The New York Department of Corrections and Community Supervision offers an online search tool for inmate information. Requesters can use solely the name or use a name in combination with a birth year. Requesters can also use the Department identification number of the New York State identification number. However, if you use one of those, do not put in a name or birth years as they are meant to be used alone.

In the state of New York, the official registration of birth records started in 1881. For records before 1914 in Albany, Buffalo and Yonkers or before 1880 in any other city you need to write to the Registrar of Vital Statistics in the city where the registrant was born.To access New York Birth Records, a request has to be made to the Certification Unit at Vital Records.
