Section 6530 of the New York Education Law defines professional misconduct and includes: 24) Practicing beyond the scope of practice permitted by state law and performing professional responsibilities a licensee knows he/she is not competent to perform.. 25) Delegating professional responsibilities to a person when the licensee delegating such responsibilities knows or has reason to know that such person is not qualified, by training, experience or by licensure to perform.

FIVE years ago, Maria Aiello, seeking to banish the hair on her upper lip, looked into laser hair removal, but she balked at the $900 that her dermatologist would charge. So she put the idea out of her head until late last year, when friends were raving about how well the process worked and she noticed that many spas and salons were offering it. She checked back with her dermatologist and found that his price had declined to about $650.
“It’s still a lot of money, but it was worth it for that price,” said Mrs. Aiello, 33, a homemaker from Queens, who said the fee included three laser sessions. “I did my lip and it worked. I’m keeping an eye on it now, and if there’s any regrowth I’ll do another round.”
In a continuing battle, many women as well as some men have tweezed, shaved, waxed and even electrified unwanted hair. The laser method — which sends a beam of light into hair follicles to damage the roots — is a relatively new addition to the arsenal. A device for laser hair removal first received Food and Drug Administration clearance in 1995.
