New York Marijuana Growing Laws
Home cultivation is currently not permitted in New York, but it will be soon. The March 2021 law requires the state to set homegrow rules for medical patients by the end of 2021, and for all adults by the end of 2022.

Cannabis is legal for both medical and recreational use in New York. Medical marijuana was legalized in 2014 under the states Compassionate Care Act , and in 2021the state passed the . This bill allowed for the possession, purchase, and transport of cannabis, and created the Office of Cannabis Management for the state, which is governed by the Cannabis Control Board. This law also created changes to the Medical Marijuana Program in the state with planned future expansion.
What Lawmakers Say About Ny Recreational Marijuana
Legislative debate Tuesday over legalizing recreational marijuana touched on everything from the lack of a marijuana breathalyzer to enforce drugged driving laws to rules for prohibiting cannabis edibles that mimic candy.
The legislation calls for creating a new Office of Cannabis Management to implement regulations and oversee the entire industry, including the recreational marijuana, medical marijuana and hemp sides.
Krueger noted the cannabis office will be tasked with finalizing some details for keeping marijuana away from children, such as deciding which types of edibles to ban besides gummies shaped like bears, fish and other animals.
“We will have an agency that will be writing regulations and can address those kinds of questions,” she said.
Meanwhile, state health officials and experts will study how to improve drugged driving enforcement, including the potential use of saliva-based marijuana tests, according to the legislation.
Currently, law enforcement in part relies on officers specially trained in conducting field sobriety tests for marijuana impairment, called drug recognition experts, as well as blood tests.
The new cannabis office will be overseen by a board appointed by the governor and legislative leaders. The office will also have an executive director appointed by the governor.
“My family members have gone through drug addiction. Very sad what I’ve been going through, and it started with marijuana,” he said, referring to cannabis as a gateway drug.

New York Marijuana Laws
After legalizing cannabis for medicinal use in 2014, New York has finally ironed out any outstanding concerns and passed the bill to legalize recreational use as well.
Before the legal sales of weed can commence, a regulatory system needs to be put in place to oversee this industry. The first legal purchases will only take place within a year.
The updated New York marijuana laws are as follows:
- Adults over 21 can possess a maximum of three ounces of cannabis and 24 grams of concentrate.
- Its no longer an offense to have weed in public view.
- The fine for second-degree possession of marijuana, which was an ounce, has been reduced to $50 from $100.
- A previous penalty for possession of 25 grams has been increased to an ounce.
- The penalty of first-degree possession is now a maximum fine of $200. This was previously a misdemeanor.
- Any convictions that occurred before the decriminalization of marijuana will be expunged.
- Smoking weed will now fall under the Clean Indoor Air Act. This means that the same penalties enforced on prohibiting cigarette smoking in certain areas will apply to marijuana smokers.

When Can I Apply
CAURDs application window is expected to open at the end of August. Those interested must pay a $2,000 nonrefundable application and license fee. Applicants also must indicate the preferred geographic region to operate a dispensary.

What About Impaired Driving
It remains illegal to drive under the influence of , just as its illegal to drive while intoxicated by alcohol, and the police will still be able to pull people over who they believed were impaired.
An officer can use the smell of burned cannabis as a reason to suspect that a driver is under the influence, but he or she is only allowed to search parts of the car that are readily accessible to the driver, so not the trunk, for example.
Unlike with alcohol, there is currently no easy way to quickly and reliably measure whether a person is under the influence of cannabis, especially since traces of the drug can stay in someones system after the high has worn off.
So under the new law, the Health Department will be required to look at emerging devices that could potentially allow officers to use a saliva test to detect whether a driver is high.

For the past few months, anyone visiting Katzs Deli in the Lower East Side of Manhattan as famous for its role in When Harry Met Sally as it is for pastrami has queued near a green-painted food truck, strategically parked on Houston Street to capture Katzs foot traffic, adorned with multi-colored LED signage advertising the citys latest hot delicacy: cannabis.
Passersby can stroll up to the trucks sales window and peek at a menu written in marker on a white dry-erase board and ask to see and smell a sample before forking over $60 cash for 3.5 grams, the cannabis industrys standard serving size.
Business is so good that in addition to the truck here and the others outside a Trader Joes in Brooklyn and a major subway transfer in the Upper West Side, the Green Truck recently opened an eighth location, a block away from Grand Central. Though none of this is technically legal even if the $60 is legally a donation, as the bored-looking man running the truck explains nobody cares enough to intervene. On a recent visit to Katzs, an NYPD police car was parked behind the Green Truck, where donations or sales, whichever, continued as if police did not exist.
The state wont issue the first sales licenses until this fall but in the meantime, an enormous, unregulated, and technically illegal gray market has emerged to fulfill demand.

Where Do I Buy Medicinal Marijuana
There are ten medical-marijuana companies operating 38 dispensaries including 12 in New York City as of November. You can get a prescription for a limited number of oils, ointments, capsules, powders, vaporizers, and chewable gummies, but not every dispensary has every variety. The new law will allow dispensaries to offer a wider array of products including whole flower the dried bud of a marijuana plant and more types of edibles. Thats a game changer for consumers because smokeable flower is substantially cheaper than processed products which can cost between $80 and $100 and as high as $350, which insurance doesnt cover. Trying To Create An Equitable Program

Alexander said the Office of Cannabis Management expects that because New York will provide ongoing support, operators will hold on to their licenses and continue to grow their businesses after the four years. Some, however, have raised concerns that large multi-state marijuana companies could then buy up the initial licenses.
Adduci said she hopes New York takes note from other states who have made those mistakes, adding that shes already started to see predatory deals emerge.
Predatory deals come across my desk and say, Hey, if you win a license Ill give you $10 million for it, she said.
DiPisa argued that a takeover by large cannabis industry operators would usurp the entire reason for the program wanting New York to own its cannabis market. He, however, argued that preventing social equity owners from selling their licenses would also go against the intentions of the program.
The whole point of this is to put them on a pedestal, give them the opportunity to be profitable, he said. Why shouldnt they be able to build a business, realize the American dream and sell their business off? Its honestly something that I dont know how to make heads or tails of. Its a hard thing to reconcile because you want both, but you cant have it all.

New York Regulators Vote To Let Medical Marijuana Patients Grow Their Own Starting Next Month
As New York marijuana regulators continue to accept applications for the first adult-use cannabis retailer licenses from people directly impacted by the drug war, officials on Tuesday voted to adopt home grow rules for medical cannabis patients, as well as another round of conditional marijuana processor and cultivator business applications.
The Cannabis Control Board accepted a resolution to have the state adopt rules for medical cannabis patients to grow their own plants for personal use. They also accepted updated hemp cannabinoid regulations and gave the green light to a limited partnership agreement between the Dormitory Authority of the State of New York and Social Equity Impact Ventures to advance industry equity.
The adoption of the medical cannabis home grow resolution comes about a year after draft regulations were first proposed and several months after the board accepted revised rules following a public comment period. Now CCB has directed the Office of Cannabis Management to formally send the approved regulations to the New York State Department of State.
