Legislative debate Tuesday over legalizing recreational marijuana touched on everything from the lack of a marijuana breathalyzer to enforce drugged driving laws to rules for prohibiting cannabis edibles that mimic candy.

The legislation calls for creating a new Office of Cannabis Management to implement regulations and oversee the entire industry, including the recreational marijuana, medical marijuana and hemp sides.

Krueger noted the cannabis office will be tasked with finalizing some details for keeping marijuana away from children, such as deciding which types of edibles to ban besides gummies shaped like bears, fish and other animals.

“We will have an agency that will be writing regulations and can address those kinds of questions,” she said.

Meanwhile, state health officials and experts will study how to improve drugged driving enforcement, including the potential use of saliva-based marijuana tests, according to the legislation.

Currently, law enforcement in part relies on officers specially trained in conducting field sobriety tests for marijuana impairment, called drug recognition experts, as well as blood tests.

The new cannabis office will be overseen by a board appointed by the governor and legislative leaders. The office will also have an executive director appointed by the governor.

“My family members have gone through drug addiction. Very sad what I’ve been going through, and it started with marijuana,” he said, referring to cannabis as a gateway drug.

Passersby can stroll up to the trucks sales window and peek at a menu written in marker on a white dry-erase board and ask to see and smell a sample before forking over $60 cash for 3.5 grams, the cannabis industrys standard serving size.

Business is so good that in addition to the truck here and the others outside a Trader Joes in Brooklyn and a major subway transfer in the Upper West Side, the Green Truck recently opened an eighth location, a block away from Grand Central. Though none of this is technically legal even if the $60 is legally a donation, as the bored-looking man running the truck explains nobody cares enough to intervene. On a recent visit to Katzs, an NYPD police car was parked behind the Green Truck, where donations or sales, whichever, continued as if police did not exist.

New York Regulators Vote To Let Medical Marijuana Patients Grow Their Own Starting Next Month

As New York marijuana regulators continue to accept applications for the first adult-use cannabis retailer licenses from people directly impacted by the drug war, officials on Tuesday voted to adopt home grow rules for medical cannabis patients, as well as another round of conditional marijuana processor and cultivator business applications.

The Cannabis Control Board accepted a resolution to have the state adopt rules for medical cannabis patients to grow their own plants for personal use. They also accepted updated hemp cannabinoid regulations and gave the green light to a limited partnership agreement between the Dormitory Authority of the State of New York and Social Equity Impact Ventures to advance industry equity.

The adoption of the medical cannabis home grow resolution comes about a year after draft regulations were first proposed and several months after the board accepted revised rules following a public comment period. Now CCB has directed the Office of Cannabis Management to formally send the approved regulations to the New York State Department of State.
