Their lawyers have argued that the restrictions were straightforwardly unconstitutional based on two relatively recent decisions made by the court that have reframed the way the Second Amendment is interpreted. The court now holds that the amendment protects an individuals right to have a gun for certain purposes, including self-defense.

Joseph Blocher, a Second Amendment expert at Duke University School of Law, said that a number of different outcomes were possible if the court were to overturn the New York law.

New York politicians have expressed considerable concern about the case. On Thursday, Mayor Bill de Blasio said that it really worried him.

The US Supreme Court appeared poised Wednesday to overturn a New York law that limits someones ability to legally carry a concealed gun in public.

The conservative-leaning high court listened to about two hours of arguments in a case brought by a New York chapter of the NRA and state weapons owners, who have sought to overturn a 1913 gun control law.

The suit, which was struck down by lower courts, seeks to expand the ability of New Yorkers to legally carry concealed weapons.

The panels conservative justices who outnumber its liberals 6-3 questioned the current law during Wednesdays hearing.

According to the law, most applicants seeking to carry handguns without restrictions need to get permission from a state firearms licensing officer and prove they have an actual need for the weapon for self-defense.

Justice Samuel Alito questioned why celebrities, state judges and retired police officers should be given the right to carry a concealed weapon without going through those steps in New York, while ordinary, law-abiding citizens are denied it.

Brett Kavanaugh, a President Donald Trump appointee, wondered why a specific reason should need to be given to apply for a concealed-carry weapon.

Why isnt it good enough to say, I live in a violent area, and I want to defend myself? he said.

Still, the Democrat-appointed justices appeared concerned about the prospect of allowing concealed-carry weapons to proliferate in public spaces.

The Second Amendment of the U.S. Constitution states that a well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. Fast forwarding to today, its been thirteen years since District of Columbia v. Heller, where the Courts conservative majority declared an individual right to gun ownership and eleven years since the Court applied that ruling to the states in McDonald v. City of Chicago. Since then, the Court has not reviewed any major Second Amendment cases, regardless of the over 1,400 that have been filed to challenge existing gun regulations.

Carrying a concealed weapon without a permit is a class A misdemeanor in New York. Penalties include up to 1 year in jail, three years probation, and a fine of up to $1,000. Anyone arrested for carrying a concealed weapon can also potentially be charged with criminal possession of a firearm in the second, third, or fourth degree and face anywhere between 1 and 15 years in prison.

All states allow transportation of an unloaded firearm in a secure container, but carrying a loaded gun is another matter. Most states require a loaded gun be concealed and on your person.
