What Are The Concealed Carry Laws In New York

Guns And Gun Control In The Us

New York Officials Oppose Bill Extending Concealed Carry Across State Lines

Their lawyers have argued that the restrictions were straightforwardly unconstitutional based on two relatively recent decisions made by the court that have reframed the way the Second Amendment is interpreted. The court now holds that the amendment protects an individuals right to have a gun for certain purposes, including self-defense.

Joseph Blocher, a Second Amendment expert at Duke University School of Law, said that a number of different outcomes were possible if the court were to overturn the New York law.

New York politicians have expressed considerable concern about the case. On Thursday, Mayor Bill de Blasio said that it really worried him.

Its a little surreal that we have justices in Supreme Court suggesting that it would be great to have more and more people armed walking the streets of the city, he said.

The US Supreme Court appeared poised Wednesday to overturn a New York law that limits someones ability to legally carry a concealed gun in public.

The conservative-leaning high court listened to about two hours of arguments in a case brought by a New York chapter of the NRA and state weapons owners, who have sought to overturn a 1913 gun control law.

The suit, which was struck down by lower courts, seeks to expand the ability of New Yorkers to legally carry concealed weapons.

The panels conservative justices who outnumber its liberals 6-3 questioned the current law during Wednesdays hearing.

According to the law, most applicants seeking to carry handguns without restrictions need to get permission from a state firearms licensing officer and prove they have an actual need for the weapon for self-defense.

Justice Samuel Alito questioned why celebrities, state judges and retired police officers should be given the right to carry a concealed weapon without going through those steps in New York, while ordinary, law-abiding citizens are denied it.

Brett Kavanaugh, a President Donald Trump appointee, wondered why a specific reason should need to be given to apply for a concealed-carry weapon.

Why isnt it good enough to say, I live in a violent area, and I want to defend myself? he said.

Still, the Democrat-appointed justices appeared concerned about the prospect of allowing concealed-carry weapons to proliferate in public spaces.

Introduction

Gun rights have been a hot topic throughout the United States for many years, likely since the passage of the Second Amendment to the U.S. Constitution. The Second Amendment of the U.S. Constitution states that a well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed. Fast forwarding to today, its been thirteen years since District of Columbia v. Heller, where the Courts conservative majority declared an individual right to gun ownership and eleven years since the Court applied that ruling to the states in McDonald v. City of Chicago. Since then, the Court has not reviewed any major Second Amendment cases, regardless of the over 1,400 that have been filed to challenge existing gun regulations.

What are the current concealed carry permit regulations?

The current law in NY requires a specific stated reason from applicants that need a gun for self-defense. NY does not issue concealed carry permits out of the general desire for self-defense. Instead, applicants must show that they have proper cause to carry a concealed handgun. A state firearms licensing officer must be convinced of an actual, non-speculative, need for self-defense. This law is analogous to restrictions that run from Medieval England through the founding of the United States and up to today.

New Yorks weapons laws are among the most restrictive in the nation. Although repeatedly challenged, the states courts have typically upheld these laws because the Constitution of New York does not explicitly state that residents have the right to keep and bear arms. Carrying a concealed weapon without a permit is a serious offense in the state. The restrictive laws also apply to deadly weapons, such as some types of knives, explosives, and stun guns.

Concealed Carry In The Car

New York concealed carry laws challenged in court :: Guns.com

All states allow transportation of an unloaded firearm in a secure container, but carrying a loaded gun is another matter. Most states require a loaded gun be concealed and on your person. Some states allow for an openly carried gun to be kept loaded in the car, so long as it’s in plain view, but the requirement to conceal the firearm on your person while driving is the most common. Some states require a permit to have a loaded gun in a vehicle at all, and others have different rules. Make sure you know what your state’s laws are, before putting a loaded gun in the car.

As with most aspects of concealed carry, a small change in details makes a big difference in legality. This is the case with interstate transportation. The Firearms Owner Protection Act provides some protections when transporting a gun across state lines, but none against violating the laws of the state you are in. FOPA does not protect you against New York’s ban on magazines with more than 10 rounds of capacity or New Jersey’s ban on hollow point ammunition.

Conceal And Carry Restrictions Can Help Protect Freedom Of Expression

The Supreme Court is set to hear arguments in an important legal challenge to New Yorks concealed carry law. The law requires people registering for concealed carry gun licenses to demonstrate proper cause in order to do so, and in particular to demonstrate a specific need for self-defense if they seek to carry a gun for that purpose.

The question in the case is whether the Second Amendment permits New York to restrict the carriage of firearms in this manner. The meaning, intent and reach of the Second Amendment remain a matter of deep controversy, but the Supreme Court has made clear that Second Amendment rights are not absolute. Regulations on carrying guns in public, both open and concealed, have been common measures throughout American history as a means of maintaining peace and safety in public places. On September 21, the ACLU and the New York Civil Liberties Union filed a friend-of-court brief in the Supreme Court in New York State Rifle & Pistol Association v. Bruen, arguing that New Yorks limits on carrying guns in public spaces are constitutional. In particular, we argued that states have an important, and historically grounded, interest in restricting the carrying of guns in order to make public spaces safe for democratic participation, including First Amendment activity such as assembly, association, and speech.
