Starting in 1881, New York required that village, town, and city clerks record births. Copies of these births were then filed with the State Department of Health. Due to earlier city laws, births recorded in Albany, Buffalo, and Yonkers were not copied to the State between 1881 and 1914.

After 1914, copies of all birth records were filed with the New York Department of Health. Copies can be obtained either through the village, town, or city clerk where the birth took place or by contacting the Department of Health.

What Is The Difference Between A Certified Copy Of Birth Certificate And A Certified Transcript Of Birth

Above is an image of a certified copy of NYS birth certificate issued by the NYS Department of Health in Albany. It is eligible for a NY apostille or the legalization by a foreign embassy. It is signed by the current Director of Vital Records and bears the raised seal of the NYS Department of Health. This is considered to be a long form birth certificate as it contains a lot of information: parents’ information , additional information on the child’s birthplace, and the information on the doctor that assisted in the birth of the child. The long form also usually includes the signature of the doctor involved and at least one of the parents.

New York State Department of Health also issues Certified Transcripts of Birth.

The image to the left is a Certified Transcript of Birth issued in 2015. It is considered to be a short form birth certificate. Certified Transcripts of Birth typically include the child’s name, date of birth, sex, and place of birth, and the names of the child’s parents, including the mother’s maiden name.

Certified Transcripts of Birth are eligible for a NY apostilles or the legalization by foreign embassies.

Obtaining Birth Certificates For Deceased Relatives From Ny State

New York State requires a court order to obtain any birth or death certificates for deceased relatives. People want these birth certificates for a variety of reasons but I was looking to obtain my Grandfather’s birth certificate in order to qualify for Italian Dual Citizenship . Who Is Eligible To Get A Copy Of A Birth Certificate

  • The person named on the birth certificate.
  • A parent of the person named on the birth certificate. The requesting parent’s name must be on the birth certificate.
  • A spouse, child or others, but only by order of a New York State court.

    Online requests for birth records made via the NYC third-party service provider are reviewed within 24 hours on weekdays and shipping time is dependent on the delivery period. The standard delivery is via the US Postal Service, while requesters are charged additional fees for using UPS express mail delivery. Note that express mail delivery is not available for P.O. Box addresses.

    Internet requests for birth certificates in New York State are processed within 5 – 10 business days of receipt.     Researchers should begin by searching New York State’s index to all marriage records from 1881. Marriage indexes are available online at Internet Archive for 1881 to 1964. As with other vital records, compliance increased as time went on, and records between 1881 and 1913 may be incomplete.

    Also, many counties hold marriage license files, some of which may be found in FamilySearchs New York, County Marriages, 1847-1848 1908-1936 database.

    Vital Records:

    Birth, marriage, and death certificates are not filed in the Broome County Clerk’s Office. They’re recorded in the City, Town or Village where the event took place.

    These vital records can also be ordered online through the NYS Department of Health by visiting www.health.ny.gov/vital_records or by calling 1-877-854-4481.

    Pennsylvania birth, death and marriage records can be ordered online through the Pennsylvania Department of Healths Division of Vital Records at www.health.pa.gov/topics/certificates/Pages/Vital%20Records.aspx.

    Officiating Weddings:

    The Broome County Clerk’s office does not register marriage officiants.

    According to the New York State Department of Health’s website , there is no requirement for officiants to register if the marriage is performed in New York State outside of the five boroughs of New York City.

    In 1847, New York State passed a law requiring that doctors and midwives report births, marriages, and deaths to the trustees of local school districts. Due to the complexities of this law, it quickly fell into disfavor and few communities reported births after 1850 . Extant records for this time period are either held by the local village, town, or city clerk or by the county clerk.

    Access Adoption Records Through Consent

    In some states, you may be able to access identifying information through a mutual consent registry. Using these registries, all involved in an adoption can declare what information may be disclosed. Some states may require the consent of both the birth parents and adoptive parents for the release of records. However, the release of information varies by state.

    If your state does not maintain a mutual consent registry, there are other ways to obtain records through consent. Public or private agencies can locate birth parents in some states. When an agency contacts birth parents, they can find out identifying information through:

    • Confidential Intermediary System The court gives permission to a court-certified confidential intermediary. This permission grants them access to sealed adoption records. They can also contact the birth parents to obtain consent for the release of identifying information.

    • Affidavit System – Birth parents can officially file their consent or refusal to be identified or contacted.

    Not Born In New York State

    To change the name of someone who was not born in New York State you can use any document that proves when and where the person was born. An official birth certificate should be on file in the place of birth. These records are filed permanently in a State vital statistics office or in a city, county, or other local office. To get a certified copy of the birth certificate, write or go to the vital statistics office in the state or area where you were born. The National Center for Health Statistics has a list of state agencies that keep vital records on their website.
