NEW YORK – If you’re facing eviction, it may be harder to get a free attorney.
Tuesday, Legal Aid attorneys said they cannot take new housing court cases in Queens this month, highlighting a much bigger problem.
CBS2’s Aundrea Cline-Thomas explain why, and what this means for tenants.
“I’m scared right now,” said Arrouna Soumarhoro, who has lived in a Bronx apartment for more than 20 years, but is now facing eviction despite trying to pay his landlord thousands of dollars.
“Have you been to court with a lawyer?” Cline-Thomas asked.
“No, I go by myself,” he said. “If I go by myself, I’ll never win. You’ll never win.”
Soumarhoro is among many tenants across the city who cannot find a lawyer, although the right to counsel law is supposed to give him access to one for free.
“Right now, we have an excess of 40 vacancies or people who are on leave. That makes it very difficult to take on the cases that we need,” said Adriene Holder of the Legal Aid Society.
The Legal Aid Society joined the New York Legal Assistance Group citing an overwhelming caseload due to pandemic backlogs, with fewer attorneys after widespread resignations making it difficult to meet the demand.
It’s so bad in Queens, Legal Aid is not taking on new clients in housing court this month, and is appealing to the courts to delay cases.
Meantime, Soumarhoro showed Cline-Thomas his medication, saying the stress is impacting his health.

New York has been at the forefront of some groundbreaking legal decisions that enlarged the constitutional rights of people across the nation. An early U.S. Supreme Court case arising in New York helped define the governments power, and forever broadened the scope of Congress authority. In the 1824 case of Gibbons v. Ogden, the Court struck down a New York law requiring steamboat operators to hold a New York license before traveling between New York and New Jersey. The Court found the law unconstitutional because it interfered with Congress power to regulate commerce.
In another case originating in New York, the U.S. Supreme Court expanded the freedom of the press. In the defamation case New York Times Co. v. Sullivan, the Court enlarged First Amendment protections for the media by declaring that public officials cannot prevail on libel claims merely by showing that published information is false instead, public officials must also show that a defendant acted with actual malice, and reckless disregard for the truth.
Wills Are Usually Not Filed Or Recorded Anywhere While A Person Is Living
When a person makes a will in NY, its usually not filed with the court while they are living. A will is kept by the person who made it, or by the attorney who helped them. The will-maker keeps it in their house, or the attorney keeps it in a safe in their office. There is no database or central depository for wills of people who are living.
Once someone dies, their will has to be filed with the court. It does not mean that it always happens. It is possible that a will is lost, the person who made the will changed their mind and destroyed it, or someone else destroyed it. Or it got destroyed in a flood for example. All kinds of things happen. Because a will does not have to be filed or registered anywhere until the will-maker dies, not all wills make it to court.
If a will is last seen in possession of the person who made it and is not found after their death, then the law presumes that the person who made the will changed their mind and destroyed the will.
