Times Square Adult Entertainment Was At Center Of First Amendment Struggle

In the 1990s, New York mayor Rudolph Giuliani announced his intention to clean up Times Square by, among other things, controlling the noise and relocating the areas booming sex shop business. The city passed laws regulating how much of a stores capacity could be devoted to adult material and where such shops could be located. Although the rules applied throughout the city, Times Square served as the battleground.

In Hickerson v. City of New York , First Amendment advocates were stymied in their efforts to defend the expressive rights of the adult entertainment shops. A U.S. appellate court upheld the district court decision ruling that the Constitutions full faith and credit clause prevented the relitigation of zoning issues that the state court had already decided in the citys favor. Ultimately, the cleaning up of Times Square paved the way for a more family-friendly area.

Times Square Hits Hard Times

World Visits: Christmas Times Square In New York City

The good times stopped when the Great Depression hit in 1929, and financial difficulties made it almost impossible for theaters and other forms of entertainment to survive. People were looking for cheaper activities, which is how Times Square began to devolve into the crime-heavy place you may have heard of in the 1970s and 1980s. Empty theaters transformed into radio stations, TV studios, and some shady establishments with bad reputations. The proximity to tunnels, highways, and the bus stations made Times Square the first stop for vagrants from out of town.

On Monday, the Hard Rock Hotel New York opened at the northeast tip of Times Square, the latest massive hotel brand to open in the area since the beginning of the pandemic.

The newly built slender glass tower opened its doors at 159 W. 48th St., bringing 446 rooms and a new live-event venue to the Theater District. Room rates will start at $475 per night.

Fittingly, the citys first Hard Rock Hotel and a sister property to the longstanding Hard Rock Cafe on Broadway stands on Music Row, the stretch along 48th Street once packed with recording studios and instrument, sheet music and gear stores that fed the citys music scene.

As both a brand nod and homage to the location, the event space, dubbed simply the Venue on Music Row, was custom-built to present music, comedy and other live entertainment.

We looked at dozens of sites around the city and this really is the perfect fit, Jim Allen, chairman of Hard Rock International and CEO of Seminole Gaming, said of the location. There is the business side of Midtown on one side and Times Square on the other. This is extremely exciting for us.

The music-influenced Hard Rock brand began in London in the 1980s with the Hard Rock Cafe on Park Lane, and it grew into an international brand with 253 properties.

Along with the venue, the hotel houses RT60 rooftop bar and lounge on the 34th floor.

The eye-catching 36-story structure also goes down 80 feet below ground level.
