When Benefits Begin

Employees must use all available sick leave before New York State Disability partial income replacement benefits will be paid. If an employee does not have any sick leave to use, benefits begin on the eighth consecutive day that the employee is unable to work because of his or her disability .     New York State Paid Family Leave provides eligible employees with up to 12 weeks of job protected, paid time off to bond with a new child, care for a family member with a serious health condition, or to assist loved ones when a family member is deployed abroad on active military service.     There are two ways to apply for disability benefits in New York. You can either apply online at or you can apply in person at a local Social Security office. Schedule an appointment by calling 1-800-772-1213 between 7:00 AM and 7:00 PM Monday through Friday or show up at the office without an appointment.     • Necessary medical care is provided no matter how short or how long the length of the disability. The injured or ill worker who is eligible for workers’ compensation will receive necessary medical care directly related to the original injury or illness and the recovery from his/her disability. The treating health care provider must be authorized by the Workers’ Compensation Board, except in an emergency situation.

    Under New York State Law, the RF provides this off-the-job illness or injury benefit, and pays the full cost of the coverage, to all employees. In the event of a disability you will begin receiving income replacement after you have exhausted your sick leave accruals.
