With one major exception, you are not required to register with any agency in New York before performing ceremonies in the state, but always keep in mind that you must present your credentials to any legal authority upon their request which can include the town clerk, county clerk, or any representative of the state as well as the bridal couple.

Online Ordinations Are They Legal On Long Island

The short answer is no. If it were already legal, there wouldnt be legislation before our state legislature in Albany trying to make it legal, or at least expand on who can legally perform marriage ceremonies in New York State.

If a new bill passes, that makes online officiants legally able to sign a marriage license, this is where you will find that information as well.

In 2017, the Towns of Smithtown and Islip limited their officiants list to only those with Civil Authority. This is because of the liability issues created by recommending someone to perform a service that may or may not be legal. Smithtown and Islip now only give information for sitting Judges, acting Mayors, appointed Marriage Officers and Clerks currently in office.

Congratulations on being asked to perform a wedding in the state of New York! There are a few details to iron out, including whether the ceremony will be performed within NYC or in a more rural area. While spring and summer weddings are certainly the most popular, keep in mind temperatures and humidity can get quite high during the summer months, so you will want to dress accordingly and provide space for guests to cool off and escape the sun. To officiate a wedding within New York City limits requires the minister / rabbi / clergy-member to register with the New York City Clerks Office. Fill Out An Application

Once you’ve collected the documents that prove you’re of legal marrying age, a U.S. resident, and more, you’re ready to officially apply for a license. You can fill out your application online and present it at the Office of the City Clerk, or fill it out in-person at the office at your appointment. If you choose to fill it out online, just know that it expires within 21 days so make sure to get to the city clerk’s office before then. If not, you’ll need to resubmit it.

Documentation Required By The Nyc City Clerks Officeto Become An Officiant

Now heres the kicker: while the ordination certificate from your chosen church is free, the City Clerks office also requires you to produce two letters:

  • You must attach a letter from your local congregation that verifies that you are the pastor or associate pastor of the congregation and that your congregation consents to your registration with the Office of the City Clerk and
  • You must attach one of the following documents:
  • A copy of the churchs Articles of Incorporation or
  • A statement that lists the location of the church, the reason for the churchs founding, the number of trustees of the church, the approximate size of the congregation, and how often the congregation meets.

And this is how these organizations make their money. In the case of the American Fellowship Church, a copy of the membership directory was on sale for $25, and a letter of good standing on church letterhead was $10. For each of these online organizations, you can receive all of the documentation in a packet at a cost of around $35. Officiant Registration Outside New York City

If you plan on performing a marriage in New York State but outside of New York City, then you need to contact the office responsible for issuing the marriage license to the couple.That office will be able to inform you if they require ministers to register with their office before performing marriage. That being said, most jurisdictions outside NYC do not have registration requirements for ministers.

Receive Your License And Wait 24 Hours

A city clerk employee should turn over your license within moments of receiving your completed application and payment, according to the office. Your license is good for 60 days, but you can’t get hitched for 24 hours after it’s issued unless you obtain a judicial waiver. After that, feel free to wed anywhere in the stateyour license is invalid outside of New York state.

What About The Ceremony

In-person wedding ceremonies are available at Hempstead Town Hall outside on the patio, where social distancing and other safety protocols are in place. Please call to book your wedding ceremony.

There is no particular form or ceremony required except that the parties must state in the presence of an authorized member of the clergy or public official and at least one other witness that they take one another as a married couple. There is a minimum age of 18 to be a witness.

The Town Clerk’s Office has a chapel available for small wedding ceremonies. Marriage ceremonies will be officiated by a Hempstead Town Marriage Officer by appointment only on Monday, Tuesday, Wednesday and Friday, from 10 AM to 3 PM, and on Thursday, from 10 AM to 5:00 PM. The fee the use of the chapel is $65. The chapel can only be booked after obtaining a New York State Marriage license. If the license was not issued by the Town of Hempstead marriage department, please come into our office with the original marriage license and valid I.D. to schedule a ceremony.
