We often hear from ministers and officiants that are concerned about the complexities of performing marriage ceremonies in New York. While it may seem complex on the surface, its actually fairly simple and straightforward as long as you follow the rules.

Basically, you must be legally ordained before performing a wedding ceremony in New York. If you are currently ordained and in good standing with the church, you are ready to perform the ceremony this very moment.

With one major exception, you are not required to register with any agency in New York before performing ceremonies in the state, but always keep in mind that you must present your credentials to any legal authority upon their request which can include the town clerk, county clerk, or any representative of the state as well as the bridal couple.

Is there a way around this requirement? No, there isnt. But the wonderful folks at the citys Marriage Bureau actually try to make it as simple and painless as possible for you. But keep in mind that you should not wait until the last minute to get registered with them!

So easy! Now get out there and perform that ceremony!

New York State wedding officiant

The short answer is no. If it were already legal, there wouldnt be legislation before our state legislature in Albany trying to make it legal, or at least expand on who can legally perform marriage ceremonies in New York State.

Here is a link to State Senate Bill S430, which is the 2019 proposal.

The 4 previous bills that tries to give online officiants the ability to legally marry in New York are also listed in the above link to New York States website. If a new bill passes, that makes online officiants legally able to sign a marriage license, this is where you will find that information as well.

In 2017, the Towns of Smithtown and Islip limited their officiants list to only those with Civil Authority. This is because of the liability issues created by recommending someone to perform a service that may or may not be legal. Smithtown and Islip now only give information for sitting Judges, acting Mayors, appointed Marriage Officers and Clerks currently in office.

How To Plan A Wedding In New York

Congratulations on being asked to perform a wedding in the state of New York! There are a few details to iron out, including whether the ceremony will be performed within NYC or in a more rural area. While spring and summer weddings are certainly the most popular, keep in mind temperatures and humidity can get quite high during the summer months, so you will want to dress accordingly and provide space for guests to cool off and escape the sun. Also take care to wear comfortable footwear if the event will be held on a farm or a venue that will require a bit of walking. Popular wedding venues in NYC include the New York Public Library and the Plaza Hotel, both of which have been featured in numerous films. In upstate New York and even on Long Island, there are several noteworthy castle wedding venues if you want to go all out but get outside of the city. Officiants in New York State often wonder how much they should charge for their services. Most will charge more if the ceremony is being held at a swanky New York City venue or a high-end venue upstate, but even weddings at more modest venues may cost more in New York than in other, less populous states. Keep in mind any costs you may incur from having to travel or find accommodations, and of course your experience level and level of involvement in the planning process. Most officiants will charge at least $200 in New York, but some professional officiants may charge upwards of $750 for the most popular locations and times.

Honor A Spontaneous Witness

In any public place where a Wedding is being performed, passersby will be delighted they will stop respectfully and become onlookers and then, even participants when the Couple kiss and the Officiant announces to the world”I present to you these newly minted Partners Forever!” There is always enthusiastic applause! Folks are always eager to sign as witnesses, when asked. If you are in a hotel or a restaurant, there is always a Concierge or a maître d to assist with the signing.

As far as the Witness requirement goes, as a true New Yorker will say, “No prahblem.”

There is no particular form or ceremony required except that the parties must state in the presence of an authorized member of the clergy or public official and at least one other witness that they take one another as a married couple. There is a minimum age of 18 to be a witness.

The Town Clerk’s Office has a chapel available for small wedding ceremonies. Sit down with your officiant and work with them to decide how you want your ceremony to go. This is where you might want to pick out a wedding reading, tell your officiant stories of your relationship and guide them on themes or styles. Heck, you can even write their part for them if you’d like. It’s your wedding after all.

A typical ceremony order of events often includes a processional, welcome, declaration of intent, readings, vows, ring exchange, pronouncement and recessional.

Officiant Registration Outside Nyc

To the best of our knowledge, the only locations outside New York City that requires wedding officiant are certain towns on Long Island.

Our advice is to call the city or town clerks office where the couple intends to get married. That office will inform you as to whether you need to complete an application or submit your ministry credentials.

To simplify this process we recommend that you order your ministry credentials from your ordaining church just in case. Even if officiant registration is not required, it doesnt hurt to have your official ministry credentials for your own records.
