Penalties For Gun Offenses
The penalties are harsher for distribution offenses than they are for possession offenses. The police and District Attorneys Office would love to be able to clamp down on how guns are getting into the hands of the end-users, and to that end, they have made the penalties harsher for people who are the actual distributors, under the theory that if they can cut off the distribution, the violence related to guns will necessarily decrease because there will be fewer guns available.
So, the distributors of firearms are the subject of more long-term investigations and more in-depth investigations. Possessors of firearms are usually people who are caught by the police or detectives for individual cases. For distributors of firearms, they usually will employ more surveillance, long-term investigative techniques like wiretaps, or tap and trace devices on a persons phone. Law enforcement might introduce undercover officers or confidential informants to make buys to build a stronger case against an actual distributor to ensure the whole distribution organization gets busted, rather than just focus on the one person who might have been in possession of the gun.
Gun Laws In New York City
New York City has different gun control rules from those of New York State when it comes to the ownership of a rifle or shotgun. Attaining a long gun license in the the city is similar to the process one would take when licensing a handgun owners must file their application through the New York Police Department. The City of New York requires rifle owners to be:
- At least 21 years old.
- A resident of the city .
- A legal U.S. resident.
- Vetted via a background check by a licensed firearms dealer.
A person living in New York City who possesses a rifle or shotgun and no longer wishes to keep it must dispose of it only through:
- A licensed gun dealer.
- An individual who already holds a valid license or permit for a rifle or shotgun.
- A military member, police officer, peace officer or nonresident of New York City who has proof of their exemption status.

Last week, Brooklyn Borough President Eric Adams told FAQ NYC podcast that he would carry a gun and reject his security detail if he were elected mayor of New York City. This statement is not entirely surprising, given the retired New York City Police Department officers pro-gun stances, including stating in 2018 that he carries a gun in church.
Yes I will, number one, said Adams when asked if he would carry a gun as mayor. And number two, I wont have a security detail. If the city is safe, the mayor shouldnt have a security detail with him. He should be walking the street by himself.
Under federal law, qualified retired officers like Adams are allowed to carry a concealed firearm.

Types Of Licenses And Restrictions
Three types of pistol permits can be issued: possess on premises, a restricted permit limited to target and hunting only, and unrestricted concealed carry. Concealed carry permits may be restricted, but restrictions do not have the force of law. Permits issued outside of NYC are not valid in NYC unless a special license is issued granting validity.
In addition to laws pertaining to the entire state, there are additional laws and statutes pertaining to licensing and permits in some of the major cities of the state. However, NYC is the only place where an individual holding a valid New York State firearm license, obtained outside of NYC, who is traveling through NYC with a firearm must make no stops and must keep the firearm and ammo in separate locked containers that are not immediately accessible by the driver or any passengers during travel.
In New York State, pistol licenses are generally of two types: carry or premises-only. “Premises-only” is the most common license issued in NYC and is supposed to be “Shall-Issue.” Restrictions can be placed on either of the above types of licenses for example, many jurisdictions allow handgun license holders to carry handguns only while hunting and/or traveling to and from the range .

Firearms Purchase Permits And Registrations In New York
You need a purchase permit before you can buy handguns in New York. However, you do not need a permit for long guns.
Furthermore, all handguns purchased in the state must be registered before sales are complete. But there are no registrations for shotguns.
Your New York Pistol License will also identify your handgun in terms of the caliber, the model, the serial number, and the manufacturers name.
The permit will carry information such as if the handgun can be concealed carry by the holder, or meant for specific locations.
You can also amend your CCW permits if you purchase a new firearm, or you want to remove an existing one from the permit.
Rifles And Shotguns Antique Handguns
Prior to January 15, 2013, rifles deemed assault-style did not have to be registered in any jurisdiction within New York except for NYC. Since enactment of the NY SAFE Act, all grandfathered operable assault-style rifles purchased prior to January 15, 2013 must now be registered. The deadline to register these firearms was on or before January 14, 2014. NYC requires registration and has additional restrictions such as they cannot take a detachable magazine having a capacity greater than five rounds. Laws pertaining to the handling of rifles are in sharp contrast to those of handguns. For example, licensed carry of a handgun on one’s person allows the handgun to be fully loaded, including within an automobile, while visiting a place of business or while crossing a public road while hunting. A rifle or shotgun cannot be kept loaded in any of the above circumstances except for a self-defense emergency. Antiques and replica handguns must be registered to be legally loaded and fired. Contrary to handguns, N.Y. state law does not ban the open carry of shotguns or rifles, except in restricted buildings such as schools and courthouses.

Criminal Possession Of A Gun In Nyc
Criminal Possession of a Firearm was enacted in 2013 as part of New Yorks Secure Ammunition and Firearms Enforcement Act. Penal Law Section 265.01-b, Criminal Possession of a Firearm is charged in 2 circumstances. The law states: A person is guilty of criminal possession of a firearm when he or she:
- Possesses any firearm or:
- Lawfully possesses a firearm before the SAFE Act and knowingly failed to register the firearm by April 14, 2014.
The most common firearms charge in New York is Criminal Possession of a Weapon in the Second Degree for a loaded handgun outside of ones home or place of business. In that event, the Criminal Possession of a Weapon will also be charged. However, unlike the Second Degree firearms charge, which is a class C violent felony that carries a minimum prison sentence of 3.5, years, Criminal Possession of a Weapon is a class E felony, which is a much lower sentencing category.
The second provision of Criminal Possession of a Firearm requires registration of certain firearms under New Yorks Secure Ammunition and Firearms Enforcement Act or SAFE Act. Under the law, owners were required to register certain firearms by April 14, 2014. On important defense to failure to register an eligible firearm under the SAFE Act is that the firearm was rendered permanently inoperable, incapable of discharging ammunition forever.
Importance Of Proper Firearm Documentation
One of the out of state gun law considerations from New York is assuring that an individual has the proper documentation for their gun. If someone is moving to New York State, then they need to apply for and get the appropriate permit to carry. If a person owns a handgun and moves to New York, then they need to apply for the handgun license for whatever type of permit they want. It is the same thing if they own a long gun or shotgun. If someone moves to New York State, they have a grace period to obtain a permit, as long as their license to carry somewhere else is active. If they move to New York City, they cannot bring their guns.

How Do You Get An Nypd Gun License
Since 2018, the NYPD only accepts online applications for handgun licenses, rifle/shotgun permits and renewals. The process includes registering a profile, submitting fingerprints and required documents, and paying the application and fingerprint fees. Once an application has been received and reviewed, the NYPD schedules an in-person interview. Within six months, the applicant will receive a letter stating whether the application was approved.

To get a handgun permit in New York State, you will have to be a resident of NYS and be over 21 years old. You must also be of good moral character, you cannot possess a criminal record, and you must have a legally-recognized reason for wanting a firearm, among other qualifications. Can I Still Be Arrested For Weapons Charges If I Legally Own A Gun
Yes and for various reasons. Sometimes the reason is obvious a gun license is not a license to kill, harm, or rob someone else.
You may be arrested if you merely display the weapon in a threatening way. These actions and several others are in violation of NY Penal Law 265, which governs the states gun laws. If there is even one bullet in a gun, felony weapons charges may result from incidents like waving a gun around in public or showing it off to a group of onlookers. As previously discussed, we successfully resolved a felony charge in which the client faced a 15-year prison sentence for brandishing a weapon that was not fired.
Furthermore, much depends on where you are charged. Many clients wrongly believe that gun-carry licenses issued in NY State are valid throughout the state. This is a common misconception and possession of a loaded firearm is a serious charge if arrested in New York City. We will further explore this detail and others in the next Insights installment.

The NYPD may issue a carry business license for safety reasons. According to the New York State Rifle and Pistol Association, anyone who completes an application, satisfies the NYPDs general requirements, as stated above, and passes the background check is eligible for obtaining a New York gun permit. This applies to anyone, and thus, with a letter of necessity, a public figure can obtain an NYPD firearm license. Should he want one, current Mayor Bill de Blasio could be granted a concealed-carry license, regardless of whether or not the mayor dismisses his security detail.

Carrying Long Guns In New York City
In New York City, it is illegal for an individual to carry a long gun on their person or in their motor vehicle without a certificate of registration or permit. The process of getting a gun in New York can be long and understandably intimidating. Intimidating because you may not know where to start through this long and potentially hostile process. Hopefully this guide will demystify the process and get you started in the right direction.
First the good news! If you are a New York State resident and do not live in the City of New York you do not need any paperwork, license, permit or permission slip to go to a local sporting goods shop or local gun store and purchase a rifle or a shotgun. Once you go to the store you will need to fill out a form 4473 and pass a NICS before you can complete the purchase.
Now the bad news! If you want a handgun or want a rifle or shotgun and live in New York City you will need to fill out paperwork, pay a fee and apply for permission to have a pistol, rifle or shotgun. In New York State is a felony to touch an unloaded handgun even in a gun store or at the range unless you have applied to permission to possess a firearm and the permission has been granted in the form of a license. Depending on where you live to not expect a license to carry a firearm. Rather, it is more than likely that you may get a license with a lot of restrictions that for example may only allow you to have the gun in your home, at the range, hunting or fishing or some combination of those activities.
