The police and District Attorneys Office would love to be able to clamp down on how guns are getting into the hands of the end-users, and to that end, they have made the penalties harsher for people who are the actual distributors, under the theory that if they can cut off the distribution, the violence related to guns will necessarily decrease because there will be fewer guns available.

So, the distributors of firearms are the subject of more long-term investigations and more in-depth investigations. Possessors of firearms are usually people who are caught by the police or detectives for individual cases. For distributors of firearms, they usually will employ more surveillance, long-term investigative techniques like wiretaps, or tap and trace devices on a persons phone. Law enforcement might introduce undercover officers or confidential informants to make buys to build a stronger case against an actual distributor to ensure the whole distribution organization gets busted, rather than just focus on the one person who might have been in possession of the gun.

Last week, Brooklyn Borough President Eric Adams told FAQ NYC podcast that he would carry a gun and reject his security detail if he were elected mayor of New York City. This statement is not entirely surprising, given the retired New York City Police Department officers pro-gun stances, including stating in 2018 that he carries a gun in church.

Yes I will, number one, said Adams when asked if he would carry a gun as mayor. And number two, I wont have a security detail. If the city is safe, the mayor shouldnt have a security detail with him. He should be walking the street by himself.

Under federal law, qualified retired officers like Adams are allowed to carry a concealed firearm.

Types Of Licenses And Restrictions

Three types of pistol permits can be issued: possess on premises, a restricted permit limited to target and hunting only, and unrestricted concealed carry. Concealed carry permits may be restricted, but restrictions do not have the force of law. Permits issued outside of NYC are not valid in NYC unless a special license is issued granting validity.

In addition to laws pertaining to the entire state, there are additional laws and statutes pertaining to licensing and permits in some of the major cities of the state. However, NYC is the only place where an individual holding a valid New York State firearm license, obtained outside of NYC, who is traveling through NYC with a firearm must make no stops and must keep the firearm and ammo in separate locked containers that are not immediately accessible by the driver or any passengers during travel.

In New York State, pistol licenses are generally of two types: carry or premises-only. “Premises-only” is the most common license issued in NYC and is supposed to be “Shall-Issue.” Restrictions can be placed on either of the above types of licenses for example, many jurisdictions allow handgun license holders to carry handguns only while hunting and/or traveling to and from the range .

You need a purchase permit before you can buy handguns in New York. However, you do not need a permit for long guns.

Furthermore, all handguns purchased in the state must be registered before sales are complete. But there are no registrations for shotguns.

Criminal Possession Of A Gun In Nyc

Criminal Possession of a Firearm was enacted in 2013 as part of New Yorks Secure Ammunition and Firearms Enforcement Act. Penal Law Section 265.01-b, Criminal Possession of a Firearm is charged in 2 circumstances. The law states: A person is guilty of criminal possession of a firearm when he or she:

  • Possesses any firearm or:
  • Lawfully possesses a firearm before the SAFE Act and knowingly failed to register the firearm by April 14, 2014.

The most common firearms charge in New York is Criminal Possession of a Weapon in the Second Degree for a loaded handgun outside of ones home or place of business. In that event, the Criminal Possession of a Weapon will also be charged. However, unlike the Second Degree firearms charge, which is a class C violent felony that carries a minimum prison sentence of 3.5, years, Criminal Possession of a Weapon is a class E felony, which is a much lower sentencing category.

The second provision of Criminal Possession of a Firearm requires registration of certain firearms under New Yorks Secure Ammunition and Firearms Enforcement Act or SAFE Act. Under the law, owners were required to register certain firearms by April 14, 2014. On important defense to failure to register an eligible firearm under the SAFE Act is that the firearm was rendered permanently inoperable, incapable of discharging ammunition forever.

You may be arrested if you merely display the weapon in a threatening way. These actions and several others are in violation of NY Penal Law 265, which governs the states gun laws. If there is even one bullet in a gun, felony weapons charges may result from incidents like waving a gun around in public or showing it off to a group of onlookers. As previously discussed, we successfully resolved a felony charge in which the client faced a 15-year prison sentence for brandishing a weapon that was not fired.

Furthermore, much depends on where you are charged. Many clients wrongly believe that gun-carry licenses issued in NY State are valid throughout the state. This is a common misconception and possession of a loaded firearm is a serious charge if arrested in New York City. We will further explore this detail and others in the next Insights installment.
