New York Legislation Regulating Use Of E
In January 2020 New York Governor Andrew Cuomo vetoed legislation that would have amended the state’s Vehicle and Traffic Law to define and legalise the state-wide use of e-scooters and e-bicycles. The veto, which came somewhat as a surprise to observers because of the lack of any significant opposition in the legislature, disappointed supporters of the bill. Supporters of the proposed legislation argued that New York was one of the few remaining jurisdictions in the United States that had not yet legalised a safe, sustainable and affordable way of moving away from automobile traffic and supporting a large part of the state’s urban-based economy.
In May 2020 the New York state legislature passed its 2021 budget that incorporated changes to the initial effort and responded to the governor’s stated concerns. The legislation permitted localities to enact their own e-scooter and e-bicycle laws, as long as they kept within the legislation’s parameters. New York City passed its own legislation in November 2020.

Under the budget law, e-bicycles are divided into three groups:
- Class 1 pedal-assist models with a top speed of 20 miles per hour
- Class 2 throttle-assist models with a top speed of 20 mph and
- Class 3 in cities with a population of 1 million or more , throttle models with a top speed of 25 mph.
As enacted, the new law gives Cuomo the additional safety measures that he desired namely:

This potential for confusion still exists. The newly signed state law grants cities the option to opt-in. So localities can decide for themselves exactly how they want to regulate the electric vehicles or if they want to allow them at all.
The state law, for example, doesnt require riders to wear helmets. But the city of Rochester, Syracuse or Buffalo might require it. So, eBike and electric scooter legality could vary from Manhattan to Brooklyn to Queens to The Bronx and Staten Island.
Class C Motorized Bikes
To meet the Class C specifications in New York, your bike must have a top speed of 20 mph or less on level ground.
Class C motorbikes have the least amount of requirements, but you must still abide by the following:
- You need a valid drivers license
- You need to get your bike registered through the DMV.
- You need a working headlight when operating your vehicle.
- You are not required to title your vehicle.
- You are not required to carry insurance.
- You are not required to get your vehicle inspected.
- You are not required to wear a helmet, but it is highly recommended.
- You must always drive in the right hand lane or on the shoulder, but never on the sidewalk.

Electric Scooters Get The Legal Treatment Too
In addition to e-bikes, electric scooters will also be legalized. Such electric scooters would be limited to a top speed of 20 mph . Many electric scooters that can travel faster, such as the popular WideWheel electric scooter, may qualify when using speed limiting functions.
Other more serious 40 mph electric scooters likely wont make the cut.
Electric scooter sharing companies may also be allowed to begin operations in New York, assuming they follow future regulations provided by local municipalities.
However, you shouldnt expect to see any Bird or Lime scooters in Manhattan. Very specific language in the bill is used to ensure that such scooter operations wont take hold on the island, which was likely a concession to certain state senators who feared a calamity with thousands of scooters mixing with busy sidewalks and roads of Manhattan.
Privately-owned electric scooters will still be allowed in Manhattan though. And considering that there are many options for consumer electric scooters, riders arent likely to be stuck without scooter choices.
The bill is expected to pass its final vote on Wednesday before heading to the Governor to be signed into law.
Class B Motorized Bikes
Class B motorbikes have a top speed between 20 mph and 30 mph.
Like Class C bikes, you have a similar set of rules that you need to follow:
- You must have a valid drivers license
- Your bike must be registered.
- You must have a working headlight on while driving.
- You are required to carry insurance.
- You are required to wear a helmet and eye protection at all times while riding.
- You do not need to get your bike titled.
- You do not need to get your bike inspected.
- You must drive in the right hand lane whenever or on the should whenever possible, but not on the sidewalk.

Riding Like A Hooligan
Speaking of Liveforphysics, riding like a hooligan can quickly get you in trouble if you ride past the police in a provocative manner. If you are moving fast it is a good idea to be pedaling fast so you appear like you are just an athletic bicycle rider.

Or, your town might have one cop who just hates bicycle riders. My town had one that lived for just one thing, ticketing bicycles going faster than 15 mph or passing a car in a school zone. You might not be able to talk yourself out of a ticket, but it sure helps to have some idea if you are really legal or not.
Are Electric Hunting Bikes Legal In New York State
Previously, riding your e-bike on the roads and highways of New York States was illegal. You can pay up to $500 if you are caught. Only e-bikes with a maximum speed of 20mph are allowed to operate on the roads, but it still needs to be registered. In 2017, NYPD had confiscated numerous e-bikes and e-scooters before due to violations.
Today, the law allowing hunters and bikers to ride their electric bikesin New York State has been approved. Effective last April, people can freely operate their e-bikes on the city roads. So, the answer to the question: are electric hunting bikes legal in New York State is a resounding yes.
Furthermore, last August 2, 2020, a new law has been approved, allowing riders to operate their electric scooters and bikes with electric assists on the highways. Electric Bikes Are Now Legal In New York
Hearing the phrase essential worker conjures to the mind some immediate occupations: Doctors, nurses, bus drivers, maybe even grocery store workers.
Commonly overlooked in that list are the citys nearly 50,000 delivery workers, armed not with N95 masks and face shields, but with tonights dinner and likely an electronic bike. Thats especially important in this part of the Bronx where communities are defined by steep hills that are not really friendly to traditional bicycles.
Before the coronavirus pandemic, however, delivery workers rode those e-bikes at their own risk, since it was illegal to use them. Anyone with a motor-assisted bicycle could face consequences ranging from fines to having their pricey bikes confiscated.
That changed on April 3 when legalizing e-bikes became one of the cornerstones of this years state budget.
The state budget removes a final roadblock in the legal status of e-bikes. Before the budget was hashed out between the governor and the legislature, it was legal to buy, own and sell e-bikes in New York. It was just illegal to actually ride one on a public street.
Yet that didnt stop many of the citys delivery workers from using them as a way to arrive at customers doorsteps as quickly and efficiently as possible.

How Does New York State Define Electric Bikes
The state of New York defines an electric bike as a bicycle which is no more than 36″ wide and has an electric motor of less than 750w, equipped with fully functional pedals. Electric bikes are classified as:
- Class 1 bicycle with electric assist: eBikes equipped with a pedal-assist only motor which stops when the bike reaches 20 mph.
- Class 2 bicycle with electric assist: Electric bikes equipped with a motor that may be used exclusively to propel the bicycle and stop when the bike reaches the speed of 20 mph.
- Class 3 bicycle with electric assist: These can be ridden only in cities having a population of one million or more. These are bikes equipped with a motor that provides assistance only when the rider is pedaling and stops when the rider stops pedaling or when the bicycle reaches the speed of 25 mph.

New York City Legalizes E
On June 25, 2020, the New York City Council passed three pieces of micro mobility legislation that will help to expand transportation options, decrease traffic congestion, and reduce emissions. The bills follow the recent legalization of electric scooters and bicycles in New York State, and establish a pilot for a shared e-scooter program.
The first two bills lay out the legal limits for e-bike and e-scooters in New York City. Intro 1250 removed prohibitions in local law against the operation of electric scooters and limits the speed of these scooters to 20 mph. It also reduces fines for the usage of motorized vehicles that are still prohibited by local law. Intro 1264 similarly allows for the use of electric bicycles, following State guidelines. It also ensures that laws which currently apply to bicycle riders will also apply to electric bicycle riders.
The third bill, Intro 1266, establishes a shared electric scooter pilot program. DOT must issue a solicitation for the program by October 25 of this year, and the pilot program may be implemented by March of 2021. This bill also gives priority to communities underserved by bike share programs when considering the boundaries of the pilot program.

- Legalizing E-bikes boosts our economy and increases sales tax. E-bikes are already being bought and sold in New York State, which means that they are contributing to the economy despite their not yet being street-legal. When they become legal, industry experts predict that sales will double. This is based on sales data from states that have passed legislation that would define E-bikes as bicycles. In those states, bike tourism is increasing, and local economies in struggling villages, towns and cities are benefiting.
