Q: How Does Real Id Implementation Impact States That Provide Driver’s Licenses And Ids To Certain Non

REAL ID allows compliant states to issue driver’s licenses and identification cards where the identity of the applicant cannot be assured or for whom lawful presence is not determined. In fact, some states currently issue noncompliant cards to undocumented individuals. Noncompliant cards must clearly state on their face that they are not acceptable for REAL ID purposes and must use a unique design or color to differentiate them from compliant cards. DHS cautions against assuming that possession of a noncompliant card indicates the holder is an undocumented individual, given that individuals may obtain noncompliant cards for many reasons unrelated to lawful presence. Possession of a noncompliant card does not indicate that the holder is an undocumented individual, given that individuals may obtain noncompliant cards for many reasons unrelated to lawful presence.

On March 26, 2020 the U.S. Department of Homeland Security extended the enforcement deadline for REAL ID. Instead of October 1, 2020 its now October 1, 2021. What is the REAL ID?

Back in 2005 Congress passed the REAL ID Act. It was based on the 9/11 Commissions recommendations for stricter standards on sources of identification. This included drivers licenses. All of this obviously led from the attacks on 9/11 where terrorists easily got onto airplanes. The point of the Act is to not allow people to get onto a plane without these enhanced IDs. Or to enter certain federal facilities or military bases.

The phase-in for the enhanced drivers licenses has given states plenty of time to set up systems to accommodate the Act. And the time for us in New York State was going to be this October, 2020. But because of the COVID-19 pandemic, that has been stretched to October, 2021.

Q: Are All States Issuing Real Id Compliant Cards

DHS is working closely with all states and territories to provide assistance and guidance to achieve full compliance by the May 3, 2023 deadline. As of March 26, 2021, 55 states and territories are fully compliant with the REAL ID requirements, and all states are on track to begin issuing compliant licenses and IDs by the May 3, 2023 deadline.

What’s The Latest With Getting A Real Id In New York

The original deadline for New Yorkers to get a new ID was October 2020, but that date has been pushed back repeatedly because of the pandemic.

If your license is up for renewal, you can get a REAL ID at no additional cost, Schroeder said.

A standard license will no longer be accepted to fly within the U.S., so the best time to get a REAL ID is now, especially if you are renewing a license.

Schroeder added that customers whose licenses are not up for renewal can get a REAL ID for $12.50.

In addition to the REAL ID, which also is needed to enter some federal buildings, the DMV offers an Enhanced Driver License which meets federal REAL ID standards.

An Enhanced Driver License costs $30 extra and can be used as identification when returning to the U.S. by land or sea from Canada, Mexico and some countries in the Caribbean. But you still need a passport to travel internationally.

Q If My State Issues An Enhanced Drivers Licenses Is That Sufficient For My State To Be Real Id Compliant

State Enhanced Drivers Licenses designated as acceptable border-crossing documents by DHS under the Western Hemisphere Travel Initiative are acceptable for official federal purposes . However the existence of an EDL is not sufficient to consider the state to be in overall compliance for purpose of determining whether a federal agency may accept a states regular drivers license for official purposes. For example, a federal agency could accept an EDL issued from a state but not be able to accept a standard drivers license from that same state.
