The federal minimum wage is currently set at $7.25 per hour. All states must pay at least this much to workers.

However, there are different minimum wage rules for youth. The FLSA states that youth under 20 years of age can be paid a minimum wage of $4.25 for the first 90 calendar days of work.

After the first 90 calendar days of work, they must be paid at least the federal minimum wage.

What is emancipation?

  • Emancipation is the process of a parent giving up control over a minor child so that the child has control over his own legal decisions and support before he is an adult . In New York, a parent must financially support his/her child until age 21 unless the child becomes emancipated. Depending on where you live, there may be laws and limitations in place for the type of work you can perform and the number of hours you can work per week. For example, the Fair Labor Standards Act sets the following restrictions for 14 and 15-year-olds in the US:

    How Many Hours Can A 16 Or 17 Year Old Work

    For older minors, New York child labor laws allow more flexibility regarding working hours. During the school year, sixteen and seventeen year olds may work as many as four hours per day Monday through Thursday. They may earn up to eight hours daily on weekends and holidays, as long as the work takes place at or after 6:00 in the morning and ends by 10:00 at night. When school dismisses for the summer or other lengthy breaks, these teens can work up to 8 hours a day and 48 hours per week, and can stay on shift until midnight.     Some Teens Can Drive At 14

    Question: At what age can teens start to drive? I heard that some states allow drivers to drive at 14 years of age. It seems way too young to me.

    Answer: The age at which a teenager can start to drive varies greatly depending upon the state in which the adolescent resides.

    In nine states, teenagers can enter the learner stage of a graduated driver licensing system and obtain an instructional permit before turning 15 years of age. In some rare circumstances, a teen can drive alone with restrictions at age 14.

    What Hours Teens Can Work

    The New York labor law separates requirements between working during school sessions and when they are out of session. During school sessions, teens ages 14-15 can’t work more than three hours on a school day. Teens ages 16-17 may work up to four hours on school days, eight hours on non-school days and 28 hours during school weeks. They may earn minimum wage or more, depending on the job.

    When out of session, 14 and 15-year-old minors may work up to 40 hours a non-school week. Those aged 16 and 17 may have a 48 hour week. All minors may not work more than six days per week and eight hours per day.

    Children enrolled in school or home-schooled can not work during normal public school hours. An exception is made for drop-outs and those who graduate before the age of 18.

    Additionally, work hours must fall between 7 a.m. and 7 p.m.except from June 1 through Labor Day, when working hours extend to 9 p.m. Older children may work between the hours of 6 a.m. to midnightduring the school year they can work until 10 p.m.

    Teens enrolled in Cooperative Education programs can work for a maximum of six hours on a day that falls before a scheduled school day. However, these hours must be part of the educational program.
