IN an era of six-figure weddings when couples obsess about the band playlist and hand towels for the restrooms, one question may get short shrift: Is the person performing the wedding legally able to do so?
Daniel Morales and Gwendolyn Baxter thought they knew. Their outdoor ceremony two summers ago in Farmington, Conn., was performed by a friend who had been ordained online by the Universal Life Church. Having heard of other couples who were married that way, they assumed it was legal.
But Connecticut is one of a half-dozen places that do not recognize marriages performed by someone who became a minister for the sole purpose of marrying people. Such a minister doesnt meet the requirements of the state statutes, said William Gerrish, a spokesman for the Connecticut Department of Public Health.
The penalty in Connecticut for an unauthorized performance of a marriage is a fine of up to $500 and a year in jail for the officiant, though Richard Blumenthal, the Connecticut attorney general, said prosecution is unlikely.
As for the marriage, the statute is clear, Mr. Blumenthal said. Nonetheless, he encouraged couples not to panic unless the issue is forced through divorce or death, the judicial system tends to grant couples the benefit of the doubt.
But, he said, They are at risk.
If two lawyers can be duped into getting married illegally, Mr. Morales said, then anybody can.
Or perhaps not.

So we can see why you’d want your own loved one to help you and your soon-to-be spouse say, “I do.” It’s a personal touch on a deeply personal day.
There are several ways to get ordained online but the most popular is the Universal Life Church, a non-denominational religious organization founded in 1962 under the doctrine, “Do that which is right.” The church says it has ordained 20 million people in nearly six decades, most of whom signed up in order to be a wedding officiant.
“Unlike traditional religious organizations, we don’t require years of training or expensive courses to become a member of the clergy. Becoming ordained is free and can be done entirely online,” ULC’s website states.
But is it legal?
To get to the bottom of things, the Times Union spoke to two local attorneys who specialize in divorce and family law: Eric Tepper, who is the chair of the State Bar Association’s Family Law Section and a partner at the Glenville firm Gordon, Tepper & DeCoursey, and Leyla A. Kiosse, who is the president of the Capital District Women’s Bar Association and a partner at the Albany firm Tabak & Kiosse.
So, what does the law say?
So, does ULC fall into either category?
What do the courts say?

Discuss The Couple’s Overall Vision For The Ceremony
Sit down and walk through the ceremony outline with the couple, as each will want something different. With religious ceremonies, there’s a reasonably set pattern and format, but with secular weddings, the couples sometimes want to throw out the entire playbook. It’s key to talk to them upfront so you can understand their vision for the ceremony.
Once you’ve figured out all of the deadlines, write them down. Mark up a calendar to outline when you need to have your documents by, when fees need to be paid, and when you need to have the couple’s marriage license turned in.
On Our Wedding Day What Time Will You Arrive And Leave
We take timeliness very seriously. We like to arrive 20-30 minutes before the start of the wedding ceremony, and sometimes sooner for weddings with larger wedding parties. Its important for us to check in with the two of you and everyone involved in the ceremony, to ensure everyone knows their roles and so that everything runs smoothly. During this time, you may choose to complete your marriage license, or you may choose to complete this after the ceremony. We typically do not stay to attend the wedding reception.

In some states, for example, a couple doesn’t even need an officiant, while in others, only pastors can perform a wedding.
You’ll want to do your research first to make sure you’re following local state or district rules. For example, in New York City, your officiant will have to register with the court at the city clerk’s office.

Can My Friend Or Relative Still Perform My Wedding Ceremony
Many professional legally ordained officiants are happy to include friends and relatives in the ceremony. I have officiated many weddings with the couples friend or relative and give the couple the choice of having that person perform the entire ceremony or have their friend or relative do parts of the ceremony.
Another solution is to go to the courthouse before your wedding day and pay $20 for a magistrate to perform a simple civil wedding ceremony and legally marry you. Then the public ceremony later can be performed by your friend or relative.
A professional wedding officiant has the expertise and experience to work with you to create a personalized and meaningful wedding ceremony and deliver it with grace on your wedding day, knows how to conduct a rehearsal, and can handle any unexpected incidents that may arise on your wedding day whereas online ordained friends and relatives lack this experience and expertise.
It is important to me that couples marrying in North Carolina not risk the validity of their marriages and I am here to serve them in any way I can. I am most happy to answer any questions on this subject. I have been seminary-ordained since 1997 and have officiated over 2000 weddings since then.

Contact The Authority That Issues Marriage Licenses In Your Area
Before performing the ceremony, you may need to obtain documentation proving you are a minister. These policies vary by state, and sometimes even from county to county. To determine which documents are required, contact the office that issues marriage licenses in the county where the wedding will take place. This needn’t be a long conversation just tell them you’re an ordained minister planning to perform a wedding in their county, and ask what documents they need to see from you.
Most counties will request some basic documentation such as an ordination credential, a letter of good standing, or signed statements of ministry. You can find all of these items, along with a host of other ministerial products, in our extensiveonline catalog. There are some counties that do not require documentation simply being ordained is enough to perform a legal wedding ceremony. However, to avoid complications you should always check to make sure.

Officiant Registration Outside Nyc
To the best of our knowledge, the only locations outside New York City that requires wedding officiant are certain towns on Long Island.
Our advice is to call the city or town clerks office where the couple intends to get married. That office will inform you as to whether you need to complete an application or submit your ministry credentials.
To simplify this process we recommend that you order your ministry credentials from your ordaining church just in case. Even if officiant registration is not required, it doesnt hurt to have your official ministry credentials for your own records.

Wedding Ceremonies From Around The World
Commonly, wedding ceremonies around the world share rituals that are influenced by various cultural traditions. Among the many rituals practiced during wedding ceremonies, the most essential and constant element is the symbolic expression of the unification between the man and woman. The union can be signified by exchanging rings, joining of hands, tying together the garments owned by the bride and groom, or other gestures that could be a representation of the union between the couple. Likewise, many rituals that are incorporated within the ceremony are done in order to emphasize the wedding as a passage for the foundation of the family. For example, in Hindu wedding ceremonies, the couple circles a sacred fire in order to promote the fertility of their union .
Get Your Paperwork Lined Up
Regardless of whether or not a Notary Public can officiate your wedding, youll still rely on Notary officials to notarize your life documents, witness signatures, and even certify copies of a wedding license .
Legal name changes or related documents may also call for a Notary Public to preside over. Its sometimes advantageous for a Notary Public to be ordained, as theyll be able to offer this full suite of services as a seamless experience for the couple.
If a Notary Public is ordained or receives a one-day officiant designation, they can also perform the ceremony and solemnize the wedding rites. Otherwise, there will be two individuals: a member of the clergy performing the ceremony, and a Notary Public offering these specific tasks for documents. Either way, both couples and Notary Publics will need to get their documentation and paperwork lined up and ready to go prior to the ceremony.
