How To Obtain Ffl In New York State

Interview And Final Review

U.S. Supreme Court expands gun rights with concealed carry decision

The field office supervisor will issue an assignment to an Industry Operations Investigator who will conduct an in-person interview with you. The IOI will discuss federal, state and local requirements with you, and go over your application with you to ensure the information is correct and current.

The IOI will then prepare a report of his/her interview, the inspection and make a recommendation to either issue you the license or deny the application. Some reasons for denial may include failure to comply with State or local law , evidence of previous willful violations of the Gun Control Act, or falsification of the application.

The field office supervisor will also review the report and then submit his/her recommendation to the FFLC.

Assuming that all background checks have been completed and your business address and proposed business operations are in compliance with state and local law, the FFLC will complete the application processing and issue you the license. This process will take approximately 60 days from the receipt of a properly completed application.

Submit Your Ffl Application Forms

Finally, once youve made sure you meet all requirements , verified the appropriate FFL type for your business, and taken the Rocket FFL course, you are ready to pull the trigger and apply for your FFL!

Once you submit all the forms required by the ATF, they will start the process by completing a background check through the NICS on all responsible persons for the business. A responsible person is either the sole proprietor, a partner in the corporation, or will influence the businesss practices and policies.

Once all application paperwork is verified as correct, and all background checks are complete, the application is sent to a local ATF field office. An industry operations investigator will interview you to make sure all information is still correct and that you are following all state and local requirements.

After the interview, the IOI will make a recommendation to either approve or deny your FFL application. Assuming you passed, the ATF field office supervisor will then submit the approved application to the Federal Firearms Licensing Center , and you will be the next owner of an FFL!

According to the ATF website, the entire process takes about 60 days from when a completed application was first received. However, depending on the state you are setting up in, the ATF may require multiple forms and extra steps during the process.

Additionally, several online services can help you with the process. These services can help you with the paperwork, fees, and other aspects of obtaining an FFL.

Business Intent Ffl Requirement

In order to get an FFL from the ATF, you MUST have a business intent.

This may not be as big of a deal as you think but its not minor either.

You do not have to have a business plan to open up a retail gun shop. But, you must have at least some business intent.

For example, occasional sales can work whereas personal collection only for firearm enthusiasts is not. In some cases, listing and selling some firearms online is enough there is no minimum. The intent is what matters.

No intent to bring in some money with your FFL = no FFL for you. However, this does not mean that you have to be profitable.

Conducting an occasional firearm transfer can be enough.

What Is An Ffl

Having an FFL license means that someone may engage in the business of buying, selling, and/or making firearms.

Depending on the type of federal firearms license , guns can be purchased and sold as part of a business, guns can be manufactured for sale, and/or firearms can be imported.

If you also become an SOT, you can be a firearm dealer or manufacturer that works with NFA firearms like silencers , short-barreled rifles , machine guns, and more.

You dont need to be a full-fledged FFL dealer or manufacturer, you can have an FFL just to make money on an ffl transfer by charging an FFL transfer fee or you can be a gunsmith.

Ffl Requirements For Businesses/entities

NYPD unveils emergency rules for concealed carry licenses

In addition to the FFL requirements above, your business/entity must also meet some basic requirements before it can be a firearms business.

The most straightforward requirements are that your business/entity must be properly formed i.e registered with your state, an employer identification number if not a sole-proprietor, etc.

The biggest requirement, and the most difficult for some, is the business/entitys location. Simply, you must be permitted to conduct the business activity at the location youve chosen. These FFL location requirements vary depending on your state of residence.

Yes, you can get a home based FFL under federal law but your state may have special rules prohibiting it. For example, if youre living in an apartment building in New York City, you probably arent going to get an FFL.

As long as your local zoning approves of you having a firearms license at the address you choose, then the ATF will give you a home-based FFL. There are a few tricks to getting your FFL at your home I share all of these and more in the Get Your FFL Guide.

Thankfully, the ITAR requirements have changed and arent a concern anymore for most people looking for FFL licensing.

How Fastbound Makes Work Easier For A Type 07 Ffl

FastBound helps take the mountain of work out of applying for and completing the FFL form, especially the Type 07 FFL form or forms required under the NFA arms regulations. One of the biggest hurdles to those who manufacture firearms or firearms parts, even OEM parts, is the process of disposing of an item and then charting the reacquiring of those pieces into a finished part. With FastBound, the system works to complete that process for you, which decreases the amount of time and labor you would have to invest if you completed that process manually.

FastBound makes it easier and takes less time to accurately document:

  • Acquisition of new items and materials
  • Disposition of existing gun parts, materials, etc.
  • Reacquisition of disposed parts and materials as they become new parts or firearms

Under a Type 07 FFL, you must document parts or materials that eventually become higher parts and firearms, such as an upper receiver or lower receiver. FastBound makes that documentation process fast and accurate. The Type 07 FFL controls the manufacturing of gun parts and firearms and has accurate BoundBooks or records that an FFL dealer would need to ensure that their FFL license type remains in compliance.
