    Summary Of Supplemental Security Income

The Supplemental Security Income benefit provides a minimum level of monthly income to eligible individuals or couples nationwide who are aged, blind or disabled, as well as to eligible disabled or blind children. The amount of the SSI benefit will vary according to a claimants household living arrangements and other sources of income the individual or couple receives. Most states, including New York, provide a state supplement to this monthly benefit. Applicants must be aged, blind or disabled to qualify and must meet citizenship/immigration, income, and resource eligibility criteria, as well as reside in the U.S. to receive SSI. Eligible individuals and couples apply for SSI at local Social Security field offices located throughout the country.

    Note

For the sake of simplicity, although the State Supplement Program is administered by NYS, for all essential purposes the SSP is linked to SSI. Therefore, unless otherwise noted, when the text references SSI, it means both the federal SSI benefit, as well as the SSP, whether the individual receives both the federal SSI benefit and the SSP benefit or the SSP benefit only.

What Types Of Benefits Are Available

To understand how much you might receive in disability benefits, its important to understand that the Social Security Administration provides two types of disability benefits. Those include:

    • 1). Social Security Disability Insurance Benefits: SSDI benefits are benefits that are paid to disabled individuals who are considered insured by the Social Security Administration. To be insured essentially means that you worked a qualifying job through which you paid a portion of your salary into the Social Security system for a sufficient amount of time. In order to receive SSDI benefits, you must be both insured and have a qualifying disabling condition that has rendered you unable to work.
    • 2). Supplemental Security Income Benefits:SSI benefits are also benefits that are paid to disabled individuals who have a qualifying condition that has rendered them unable to work, but in contrast to SSDI benefits, these benefits are for individuals who were not otherwise insured and who make below a certain income level.

Depending on whether you receive SSDI or SSI benefits, you may receive different monthly amounts. There are other rules which apply that may affect which benefits you qualify for, including any other income or resources you may be receiving regularly. For this reason and many others, consulting with an attorney as to which benefits you may qualify for is essential.

What Is A Disability Under Ssdi Regulations

For Social Security to evaluate your application and determine that you are disabled, it must find that all of the following apply:

    • You have a medically determinable physical or mental impairment or combination of impairments.
    • The impairments are expected to last or have already lasted for at least 12 continuous months, or the impairments must be expected to result in death.
    • You are unable to engage in any substantial gainful activity because of the impairments.

Federal regulations define substantial gainful activity as work activity during which you do significant physical or mental activities. Standing, sitting, walking, and remembering things are examples of substantial activities. These activities become gainful when you do them in return for a payment in the form of earnings or, in the case of someone engaged in self-employment, for profit. The regulations state that an activity may be gainful even if you do not get paid doing it as long as it is something that usually is done for profit or pay.

Depending on what you earn SSDI may use it to determine that you engage in substantial gainful activity and do not qualify for benefits. For 2021, a person receiving or applying for SSDI benefits earning who earns more than $1,310 a month from work or self-employment is considered as engaging in substantial gainful activity. Individuals who are statutorily blind may earn up to $2,190 a month.
